Cloud Products definition

Cloud Products means our hosted or cloud-based solutions (currently designated as “Cloud” deployments) provided to you under the Agreement, including any client software we provide as part of the Cloud Products.

Cloud Products means Xpand IT Software hosted in the cloud.

Cloud Products or “Product(s)” refers to Arcserve Cloud Services, Arcserve File Backup and Recovery with Backup Analyzer, Arcserve Cloud Backup, and other off-premises backup solutions offered by Arcserve. The Cloud Products include software associated with, and necessary to the delivery of the Services, together with Documentation. Arcserve Software, however, is separately licensed and sold.

Examples of Cloud Products in a sentence

• Use of such Third-Party Products with the Products may require access to Customer Data and other data by the third-party provider, which, for Cloud Products Atlassian will permit on Customer’s behalf if Customer has enabled that Third-Party Product.

• Atlassian may process Customer Data to provide the Cloud Products and related Support or Advisory Services in accordance with this Agreement.

• Upon expiration or termination of this Agreement or a Subscription Term: (a) Customer’s rights to use the applicable Products, Support or Advisory Services will cease, (b) Customer must immediately cease accessing the Cloud Products and using the applicable Software Products and Cloud Clients, and (c) Customer must delete (or, on request, return) all license keys, access keys and any Product copies.

• Unless the parties have entered into a ‘Business Associate Agreement,’ Customer must not (and must not permit anyone else to) upload to the Cloud Products (or use the Cloud Products to process) any patient, medical or other protected health information regulated by the Health Insurance Portability and Accountability Act.

• Customer must ensure it has made all disclosures and obtained all rights and consents necessary for Atlassian to use Customer Data and Customer Materials to provide the Cloud Products, Support or Advisory Services.

Cloud Products means the product(s) owned and made available by Onapsis that are identified in the Order Form to be accessed by Customer over its internet connection when using the Cloud Services, and together with the On-Premise Product(s), the (“Product(s)”); “Cloud Services” means a technology service hosted by or on behalf of Onapsis and provided to Customer; “Customer Data” means any content or information entered by Customer into the Cloud Services, as well as any output from the Cloud Services, such as scan results information; “Documentation” means all written material provided by or on behalf of Onapsis to the Customer in connection with the Offerings; “Hosting Site”: means the internet connected hosting facility from which the system is accessed, as it may be modified by Onapsis from time to time; “Intellectual Property and/or Intellectual Property Rights” mean, collectively, all worldwide intellectual property rights in and to any works of authorship, moral rights, trademarks, patents, copyrights, trade secrets and design rights; “Object Code” means the fully compiled version of a software program that can be executed by a computer and used without further compilation; “Offerings” means the On-Premise Product(s), Cloud Product(s), Cloud Services, Professional Services, Support Services and other offerings that Onapsis makes generally available”; “Order Form” means a copy of the order for Offerings from Reseller to Onapsis which shall include (i) the Purchased Offerings; (ii) the Products being licensed, (iii) the Subscription License Term for such Products, (iv) the fees related thereto, and (v) the Volume Limitations, “On-Premise Product(s)” means the product(s) owned and made available by Onapsis that are identified in the Order Form that is delivered and deployed by Onapsis; “Purchased Offerings” means the subscriptions licenses to Offerings that are acquired by the Customer under an Order Form, whether directly or indirectly through an authorized reseller; "Professional Services" means the professional services to be provided by Onapsis as set forth in the Order Form or a Statement of Work (“SOW”) executed by both Onapsis and the respective Reseller; “Software” means the software, in Object Code only, contained in the Product(s) licensed hereunder, and including the updates thereto; “Source Code” means the human-readable version of a software program that can be compiled into Object Code, including programmer’s notes and materials and documentation, suffic...

Cloud Products means the Accelerator for Office 365 products made available by Riverbed, including all Documentation associated therewith.
