Confirmed Violation definition

Confirmed Violation means an Alleged Violation for which (1) the Registered Entity has accepted or not contested the Notice of Alleged Violation and Penalty or Sanction or other notification of the Alleged Violation, or (2) there has been the issuance of a final order from NERC or a Regional Entity Hearing Body finding a violation, Penalty or sanction, or (3) the period for requesting a hearing or an appeal has expired, or (4) the Registered Entity has executed a settlement agreement pursuant to Section 5.6.

Examples of Confirmed Violation in a sentence

  • Applicable Standard, Requirement(s) and dates: (*) Note: The Alleged or Confirmed Violation Date shall be expressly specified by Registered Entity, and subject to modification by [RE acronym], as: (i) the date the Alleged or Confirmed violation occurred; (ii) the date that the Alleged or Confirmed violation was self-reported; or (iii) the date that the Alleged or Confirmed violation has been deemed to have occurred on by [RE acronym].

  • Each Possible Violation, Alleged Violation, or Confirmed Violation shall be treated as nonpublic unless the matter is filed with the Commission as a Notice of Penalty, or, if disclosure is required, dismissed.

  • The disposition of each Possible Violation, Alleged Violation, or Confirmed Violation that relates to a Cybersecurity Incident or that would jeopardize the security of the Bulk-Power System if publicly disclosed shall remain nonpublic unless the Commission directs otherwise.

  • Section 5.1 of the CMEP recognizes the ability of NERC and Regional Entities to dispose of a Possible Violation without it becoming a Confirmed Violation:If the Compliance Enforcement Authority dismisses or disposes of a Possible Violation or Alleged Violation that does not become a Confirmed Violation, the Compliance Enforcement Authority shall issue a Notice of Completion of Enforcement Action to the Registered Entity.

  • The Regional Entity shall issue such notice within five (5) business days of issuance of the Notice of Confirmed Violation or entry into the settlement.

  • It is during this review that the Compliance Staff confirms the violation, calculates an appropriate penalty or sanction and issues a Notice of Confirmed Violation (NOCV).As stated above, differences between the revised pro forma RDA and the revised NPCC RDA are shown in Attachment 5B.43D.

  • The specified other entity must submit its written request to participate prior to, as applicable (i) the date of execution of a settlement agreement between the Compliance Enforcement Authority and the ISO/RTO, or (ii) the date that the Compliance Enforcement Authority issues a Notice of Confirmed Violation to the ISO/RTO.

  • If NERC affirms the decision, the Compliance Enforcement Authority shall issue a Notice of Confirmed Violation to the Registered Entity.

  • If no hearing request is made, the violation will become a Confirmed Violation when filed by NERC with FERC.

  • Serious violation means OCC has made a valid finding when assessing a serious complaint that alleges:

  • Violation Ticket means a violation ticket as defined in the Provincial Offences Procedures Act (Alberta).

  • Material Breach means a breach by either Party of any of its obligations under this Agreement which has or is likely to have a Material Adverse Effect on the Project and which such Party shall have failed to cure.
