Controlled Group Members definition

Controlled Group Members has the meaning set forth in Section 3.15(c).

Controlled Group Members means any of HCBF’s related organizations described in Code Sections 414(b), (c) or (m).

Controlled Group Members means, with respect to the applicable entity, any related organizations described in Code Sections 414(b), (c), or (m).

Examples of Controlled Group Members in a sentence

An Employee will be credited with one Hour of Service for each hour for which he is paid, or entitled to payment, by one or more Controlled Group Members for the performance of duties.
For purposes of the allocation limitations under Code section 415 set forth in this Article, (i) all Defined Benefit Plans ever maintained by a Controlled Group Member will be treated as one Defined Benefit Plan, and all Defined Contribution Plans ever maintained by a Controlled Group Member will be treated as one Defined Contribution Plan, and (ii) Controlled Group Members will be determined in accordance with the 50% control rule of Code section 415(h).
If a Participant's Annual Addition under this Plan and the other Defined Contribution Plans and Welfare Benefit Funds maintained by Controlled Group Members would result in the Annual Addition exceeding the Maximum Annual Addition for the Limitation Year, the excess amount will be deemed to consist of the Annual Addition last allocated.
For this purpose, Controlled Group Members will be determined in accordance with the 50% control rule of Code section 415(h).
The limitations contained in this Article will apply on an aggregate basis to all Defined Contribution Plans (whether or not any of such plans have terminated) established by the Controlled Group Members.

Controlled Group Members means any of Sunshine’s related organizations described in Code Sections 414(b), (c) or (m).

Controlled Group Members means, collectively, as the context requires, all or less than all of the members of the Controlled Group.

Controlled Group Members has engaged in a transaction with respect to any First Choice Benefit Plan, including a First Choice 401(a) Plan that is reasonably likely to subject First Choice, any First Choice Subsidiary or any Controlled Group Member to a material Tax or material penalty under any Law, including, but not limited to, Section 4975 of the Code or Section 502(i) of ERISA. No First Choice 401(a) Plan has been, or is currently, submitted under or currently the subject of an IRS voluntary compliance program submission. With respect to any First Choice Benefit Plan, there are no pending or, to First Choice’s Knowledge, threatened actions, suits, claims or other proceedings against any such First Choice Benefit Plan (other than routine claims for benefits).

Controlled Group Members means any of SSNF's related organizations described in Code Sections 414(b), (c) or (m).

Controlled Group Members means any of SWBS’s related organizations described in Code Sections 414(b), (c) or (m).

Controlled Group Members means any of SCB’s related organizations described in Code Sections 414.
