Current Film definition

Current Film with respect to each Territory shall have the meaning set forth in the applicable Exhibit.
Current Film means a feature-length film (a) that is (i) released theatrically in the Territory (“Theatrical Release”), or (ii) released theatrically, but not in the Territory (“NTR”), or (iii) released “direct-to-video” in the U.S. or the Territory (“DTV”), or (iv) released on television in the U.S. or the Territory (“TVM”), (b) with an Availability Date during the Avail Term, (c) the Availability Date for which is (i) with respect to a Theatrical Release or a NTR, no more than 60 days after its Home Video Street Date (or, if no Home Video Street Date, then 9 months after theatrical release in the Territory; or, if no theatrical release in the Territory, then 24 months after U.S. theatrical release) and (ii) with respect to a DTV or TVM, no more than 60 days after its Home Video Street Date (or, if no Home Video Street Date, then 12 months after U.S. theatrical release; or, if no U.S. theatrical release, then 12 months after initial television release in the U.S. or the Territory), and (d) for which Licensor or any other SPE Entity unilaterally controls without restriction all necessary exploitation rights, licenses and approvals hereunder (the “Necessary Rights”).
Current Film means a feature-length film (a) that is initially released theatrically, direct-to-video (“DTV”) or on television (“TVM”) in the Territory; (b) with an Availability Date during the Avail Term; (c) the Availability Date for which is either (i) no more than twelve (12) months after its theatrical release in the Territory or, in the case of a Sony Pictures Classics release, no more than fourteen (14) months after its initial theatrical release in the Xxxxxxx xx, (ii) with respect to a DTV, no more than four (4) months after its initial home video street date in the Territory or (iii) with respect to a TVM, no more than six (6) months after its initial television release in the Territory; and (d) for which Licensor unilaterally controls without restriction all necessary exploitation rights hereunder (the “Necessary Rights”).

Examples of Current Film in a sentence

  • The Availability Date for each Included Program shall be determined by Licensor in its sole discretion, provided, however, that the Availability Date for each Current Film shall be no later than the date on or after such Current Film’s applicable Home Video Street Date on which Licensor or any other SPE Entity first makes such Current Film available to any Other Distributor for VOD distribution in the applicable Territory.

  • As used in this Section 3.3 only, “Home Video Street Date” shall mean the date on which such Current Film is first made available in the applicable Territory to the general public for sale or rental, whichever is earlier, in the DVD format.

  • Each mezzanine file Copy of any DTV Current Film, any Library Film, and any other Included Program shall be supplied by Licensor to Licensee at Licensor ’s sole expense and no servicing fee shall be payable by Licensee in connection with any such delivery.

  • Notwithstanding the foregoing, Licensor may, in Licensor’s sole discretion, reduce the VOD License Period for any Current Film from ninety (90) days to a shorter period of no less than sixty (60) days upon written notice to Licensee (which may be given in the form of the VOD Current Avail List provided for such Current Film) thirty (30) days prior to the VOD Availability Date of such Current Film.

  • For each Current Film or Library Megahit that is delivered to Licensee in High Definition format, Licensor shall not be obligated to deliver a separate version in Standard Definition format with a resolution of less than 720.

Current Film means a feature-length film (a) that is released theatrically, “direct-to-video” (“DTV”) or on television (“TVM”) in the Territory, (b) the applicable Availability Date for which is either (i) no more than 12 months after its theatrical release in the Territory or, in the case of Sony Pictures Classics releases, no more than 14 months after its initial theatrical release in the Territory, or (ii) no more than four months after the Home Video Street Date in the Territory, or (iii) with respect to a TVM, no more than 6 months after its initial television release in the Territory.
Current Film a feature-length film (i) that is initially released theatrically, direct-to-video (“DTV”) or on television (“MFT”), either in the United States or in the Territory (if initially released theatrically in the Territory, “Local Theatrical”), (ii) with an Availability Date during the Avail Term, (iii) for which Licensor unilaterally controls without restriction all necessary rights to grant the rights granted hereunder (the “Necessary Rights”), and (iv) for which a Licensed Language version is available from stock-on-hand.
Current Film means a Feature Film (a) that is initially released theatrically, direct-to-video (“DTV”) or on television (“MFT”) in the United States or the Territory, (b) for which a Licensed Language version is available out of stock on hand, (c) with an Availability Date during the Avail Term, (d) the Availability Date for which is (i) for theatrical releases other than Sony Pictures Classics releases, no more than 12 months after its initial theatrical release in the United States or the Territory, or, in the case of a Sony Pictures Classics release, no more than 14 months after its initial theatrical release in the United States or the Territory, (ii) for a DTV, no more than 6 months after its LVR in the United States or the Territory, or (iii) for a MFT, no more than 6 months after its initial television exhibition in the United States or the Territory, and (e) for which Licensor controls without restriction all rights, licenses and approvals necessary to grant the rights granted hereunder (“Necessary Rights”), provided, however, that Licensor shall be deemed to have the Necessary Rights with respect to a Current Film if there are any restrictions contractually agreed to by Licensor after the Agreement Date solely for purposes of excluding such Current Film from this Agreement.

Current Film means a feature-length film made available to Licensee by Licensor for commercial airline in-flight exhibition (a) that was released theatrically, “direct-to-video” (“DTV”) or on television (“TVM”) in the Territory, (b) with an Availability Date during the Avail Term, (c) the Availability Date for which is no more than six (6) months after Licensor first made such film available for commercial airline in-flight exhibition and (d) for which Licensor unilaterally controls without restriction all necessary exploitation rights, licenses and approvals in the Territory necessary to grant the rights granted hereunder (the “Necessary Rights”), including any and all Documentaries released theatrically in the Territory on at least 1,800 screens.
