Customer Options definition

Customer Options means the series of edits and instructions mutually agreed upon by the Fund and PFPC through which the Fund specifies its instructions for Transactions listed on Attachment 1 attached hereto and made a part hereof, as such Attachment 1 may be amended from time to time.

In addition to this warranty, the company for the monthly charge shown (in addition to the monthly rental) will protect the lessee against damage to the instrument subject to the following terms and conditions: Mysterious disappearance from band room or locker is not covered. Payments made prior to date of loss are not refundable or transferable. Customer is responsible for early purchase price or payoff amount (whichever is less). For Theft, the lessee must furnish the company with a POLICE REPORT showing forced entry within 72 hours of the loss. Any fees necessary to obtain such a report will be incurred by the lessee. If the instrument becomes damaged so that it affects the performance the company will maintain and regulate it to proper playing condition. Repair due to misuse, negligence, intentional harm or abuse is not covered. The customer will be responsible to pay for repairs to refurbish the instrument. The paragraph does not apply to deterioration of appearance which does not affect the performance of the instrument, such as scratches, dents and finish. The following are SPECIFICALLY EXCLUDED FROM COVERAGE: Instrument cleaning, acid baths, drum heads, drum sticks, mouthpieces, ligatures, caps, reeds, strings, violin bows, swabs, lubricants, cases, loss or damaged parts, and special or custom equipment. Excluded is the destruction of a violin that will carry $200 deductible, cellos carry $300 deductible. Any claim for repair or replacement here under shall not be constructed to alter or diminish the terms of the accompanying rent purchase agreement, and if lessee defaults by more than 10 days in any payment there of maintenance plan will lapse as of such default and may be reinstated only by permission of the company.   • Client Software means software that allows a Device to access or utilize the services or functionality provided by the Server Software.

Font Software shall include all bitmap representations of typeface and typographic designs and ornaments created by or derived from the Font Software. Font Software includes upgrades, updates, related files, permitted copies, permitted conversions, and related documentation.

  • Existing Customer means an individual who has purchased goods or services from a person, who is the recipient of a voice communication from that person, and who either paid for the goods or services within the 12 months preceding the voice communication or has not paid for the goods and services at the time of the voice communication because of a prior agreement between the person and the individual.

  • Customer Contract means any written contract or agreement (other than trade contracts) between Seller and any of its customers (or under which Seller has rights) which has been entered into and signed by the parties thereto in connection with the publication of the Directories and corresponding provision of Directory Services.

  • Customized Software or “Customization” means any Application Software code modified or amended on behalf of the Customer. Setting of parameters, parameterization or configuration is not a Customization.

  • Licensed Materials means any materials that Executive utilizes for the benefit of the Company (or any Subsidiary thereof), or delivers to the Company or the Company’s Customers, which (a) do not constitute Work Product, (b) are created by Executive or of which Executive is otherwise in lawful possession and (c) Executive may lawfully utilize for the benefit of, or distribute to, the Company or the Company’s Customers.

  • Embedded Software means one or more software applications which permanently reside on a computing device.

  • Hosted Software means the software owned and controlled by Vendor or Vendor’s third-party contractor that supports the Hosted Software Services.

  • Customer Equipment means hardware, software, systems, cabling and facilities provided by you and used in conjunction with the Equipment that we supply to you in order to receive the Services;

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Custom Materials means Materials developed by the Supplier at the Procuring Entity's expense under the Contract and identified as such in Appendix 5 of the Contract Agreement and such other Materials as the parties may agree in writing to be Custom Materials. Custom Materials includes Materials created from Standard Materials.
