Customer Proprietary Information shall not include any information which (i) is or becomes generally available to the public other than as a direct or indirect result of a disclosure by Supplier; (ii) was known to Supplier on a nonconfidential basis prior to its disclosure to Supplier as evidenced in writing by the Supplier's documents; or (iii) becomes lawfully available to Supplier on a nonconfidential basis from a third party without violation of any confidentiality obligation by such third party known to Supplier as evidenced in writing by the Supplier's documents.
