Derivative Claimant definition

Derivative Claimant means, in relation to any particular Enrolled Claimant, any Person having or asserting the right, either statutory or under applicable common law (including the laws of descent and distribution) or otherwise, to xxx HOC or any other Released Party, independently, derivatively or otherwise.
Derivative Claimant means a spouse, parent, child who is a dependent, or any other person who may properly under applicable law assert the right to sue independently or derivatively by reason of his, her, or their relationship with (a) a Unit Owner, (b) an Invitee, (c) a Resident, (d) any person that died or sustained a personal injury (including emotional distress) as a result of the CTS Collapse, or (e) any person that suffered a loss of or damage to real property or personal property, or suffered other economic loss, as a result of the CTS Collapse.
Derivative Claimant means a person whose damages were caused by personal injury to or the wrongful death of another.

Derivative Claimant means any and all persons who have or assert the right to sue 3M or any other Released Party related to the Released Claims by reason of their personal relationship with me, and/or otherwise by, through or under, or otherwise in relation to, me, whether their right to sue is independent, derivative, or otherwise. Derivative Claimants include, but are not limited to, my parents, guardians, heirs, beneficiaries, surviving spouse (including, but not limited to, a putative or common law spouse), surviving domestic partner and/or next of kin, if any, solely in respect to Derivative Claims.
