Derivative Claimant definition
Derivative Claimant means, in relation to any particular Enrolled Claimant, any Person having or asserting the right, either statutory or under applicable common law (including the laws of descent and distribution) or otherwise, to xxx HOC or any other Released Party, independently, derivatively or otherwise.
Derivative Claimant means a spouse, parent, child who is a dependent, or any other person who may properly under applicable law assert the right to sue independently or derivatively by reason of his, her, or their relationship with (a) a Unit Owner, (b) an Invitee, (c) a Resident, (d) any person that died or sustained a personal injury (including emotional distress) as a result of the CTS Collapse, or (e) any person that suffered a loss of or damage to real property or personal property, or suffered other economic loss, as a result of the CTS Collapse.
Derivative Claimant means, in relation to any particular Eligible Claimant or Program Claimant, any Person having or asserting the right, either statutory or under applicable common law (including the laws of descent and distribution) or otherwise, to xxx Xxxxx or any other Released Party, independently, derivatively or otherwise:
17.1.18.1. by reason of their personal relationship with such Eligible Claimant or Program Claimant (or the Product User with respect to such Eligible Claimant or Program Claimant); and/or
17.1.18.2. otherwise by, through or under, or otherwise in relation to, such Eligible Claimant or Program Claimant (or the Product User with respect to such Eligible Claimant or Program Claimant); including the heirs, beneficiaries, surviving spouse (including a putative or common law spouse), surviving domestic partner and next of kin of such Eligible Claimant or Program Claimant (or the Product User with respect to such Eligible Claimant or Program Claimant).

By signing this Release, both I and any such Derivative Claimant understand and acknowledge that although I have received disclosure documents regarding the allocation of the Settlement Fund, which enables me to estimate my Individual Plaintiff Settlement Payment, there is no assurance at this time as to the precise amount of such payment, and this fact shall in no way affect the validity or effect of this Release.

I hereby agree, jointly and severally with any Derivative Claimant executing this Release, to indemnify and hold harmless each Released Party from and against any and all claims by lienholders.

Derivative Claimant means any and all persons who have or assert the right to sue 3M or any other Released Party related to the Released Claims by reason of their personal relationship with me, and/or otherwise by, through or under, or otherwise in relation to, me, whether their right to sue is independent, derivative, or otherwise. Derivative Claimants include, but are not limited to, my parents, guardians, heirs, beneficiaries, surviving spouse (including, but not limited to, a putative or common law spouse), surviving domestic partner and/or next of kin, if any, solely in respect to Derivative Claims.
Derivative Claimant means a person whose damages were caused by personal injury to or the wrongful death of another.
