ECT Common Units definition

ECT Common Units means the class of trust units of ECT designated as common units in the ECT Trust Indenture and having the rights, privileges, restrictions and conditions described therein;

  • ECT hereby represents, warrants and covenants in favour of the holders of Exchangeable Securities, EIFH and the Fund that ECT has reserved for issuance and will, at all times while this Agreement is outstanding, keep available, free from any pre-emptive and other rights granted by ECT, such number of ECT Common Units, ECT Preferred Units or ECT Class B Units, as applicable, as are issuable under the applicable Exchange Right.
