Eligible Occupant definition

Eligible Occupant means an individual who meets the eligibility criteria prescribed in the Operating Agreement;

Eligible Occupant. An Occupant of an Owner's entire Parcel (or of all of the usable area within the building(s) on the Parcel): (a) pursuant to a lease or sublease which, as of the date of the Owner's designation of the Occupant as an Eligible Occupant, has a remaining term which exceeds five (5) years, not including periods for which the term thereof may be extended by unexercised options to extend; and (b) designated as such by the Owner of the Parcel pursuant to Section 2.1.

• However, entry into a Building Area or Exclusive Use Area may be made only after not less than five (5) business days notice has been given to the Owner and any Eligible Occupant.

• Each Eligible Occupant will be required to execute a student housing agreement with Licensor in order to occupy such student housing and will be responsible for his or her obligations under such agreement.

• However, if Owner is unable to designate areplacement Rental Inclusionary Unit on or before the expiration date of the lease, and the most recent Income Recertification shows that the household no longer qualifies for a Rental Inclusionary Unit under this Declaration, then Owner shall not renew the Occupant’s lease on the Rental Inclusionary Unit and Owner shall lease the Rental Inclusionary Unit to an Eligible Occupant.

More Definitions of Eligible Occupant

Eligible Occupant means, for any Rental Inclusionary Unit, a household whose Gross Annual Income does not exceed (i) AMI (as adjusted for the Household Size applicable to that Rental Inclusionary Unit as set forth in Exhibit A-1) multiplied by (ii) the AMI Percentage applicable to that Rental Inclusionary Unit as set forth in Exhibit A-1 increased by five percent (5%) (i.e., from seventy-five percent (75%) to eighty percent (80%)).
