Generating Capacity that is available to supply Energy, or Interruptible Load Resources that are available to Curtail Energy usage, in the event of contingency conditions which meet the requirements of the ISO.
The Customer shall be liable for and shall hold Energia harmless in respect of any and all Energy usage by the Customer prior to the Supply Period Start Date, irrespective of the reason or reasons that the Supply Period Start Date has failed to occur and whether such failure was the fault of the Customer, Energia, a third party or otherwise.
In the event that the Customer takes a supply of Energy while registered as a customer of Energia after the Termination Date, the provisions of this Agreement will survive termination and the Customer shall indemnify Energia against all and any loss, damage, cost, expense, charge, fee, claim or liability incurred by Energia in supplying the Customer or the Customer’s Premises after the Termination Date (including any Energy usage, Standing Charges or other levies or charges of any kind).
When an estimated invoice is issued, AEP Energy shall subsequently reconcile the estimated invoice and the actual metered Retail Energy usage and post any debit or credit amount to Customer’s account.
If the Meter is found to be inaccurate, we will pay the charges for the test and will recalculate Your bills for the period that the Meter was inaccurately recording Your Energy usage.
