Seller shall have the option to decrease the Contract Quantity for any or all Contract Years of the Delivery Term Contract Quantity Schedule one (1) time if the Contract Capacity is adjusted based on the Demonstrated Contract Capacity within ten (10) Business Days of Buyer’s Notice of such adjustment to the Contract Capacity or the date of the Engineer Report, as applicable.
Contractor shall administer the District Improvements and Activities and may engage one or more contractors to provide routine maintenance services including trash collection and disposal, graffiti removal, repair, landscaping, and lighting improvements or otherwise Improvements and Activities listed in within the District’s Engineer Report and Annual Report.
The Parties agree that if condition #4 set forth on page three of the BOCC Resolution has not been satisfied prior to the Effective Date, the Town will waive the requirement for an Engineer Report indicating compliance with Boulder County Multimodal Transportation Standards, and the Town will require the TIS referenced in Paragraph 9 above to be completed by Annexor in lieu of the Engineer Report referenced in condition #4 of the BOCC Resolution.
