Ex parte contact means any oral or written communication between any person in the certificate of need program or any other person involved in the decision regarding an application for, or the withdrawal of, a certificate of need and the applicant for, or holder of, a certificate of need, any person acting on behalf of the appli- cant or holder, or any person with an interest regarding issuance or withdrawal of a certificate of need.
