FOI request means a request for records pursuant to the Freedom of Information and Protection of Privacy Act.

FOI request has the meaning given to it in Clause 21.3.

• Any FOI requests received by either the PCC or the Chief Constable which relate to or touch upon the subject matter of this MOU or any matters arising from it would be brought to the attention of the other party as soon as practicable, and where necessary the PCC and the Chief Constable will provide reasonable assistance to the other in order to facilitate a timely and compliant response to the FOI request or any subsequent compliance requirement.

• Where the Commonwealth has received an FOI request for access to a document created by, or in the possession of the Contractor or its subcontractors that relates to the Contract and is required to be provided under the FOI Act, the Contractor must promptly provide the document to the Commonwealth, on request, at no cost.

• Any information shared between different partner organisations may be subject to an FOI request.

• Upon receipt of an FOI request the opinion of the originating party should be sought before decisions are made on whether to provide the information.
