Notwithstanding the foregoing, Company shall not be liable for the minimum Host Fee payment in the event Company is prevented from accepting waste volume into the Landfill due to actions, rulings or decisions of any Governmental Authority, unless such action, ruling, or decision is based on Company’s violation of any Governmental Requirement or Required Authorization.
