Upon satisfactory acceptance of the execution and completion of the works referred to in Article 16 above, FAO relinquishes control of the site and returns all responsibilities to the Water User Association by means of the signature of the Handover Certificate which should be drafted in accordance the text of Annex VIII: “Draft Handover Certificate”.
For purposes of the initial water meter reading, the parties undertake that it shall agree to the reading taken mutually on the Hand-over Date and completed as such in writing on the Hand-over Certificate.
III.1.6. The Recipient is liable to the Provider for all damages incurred by the Provider as a result of incomplete, incorrect or untrue facts given in any document or information supplied by the Provider in relation acceptance of the Subject or the drawing of the Loan, particularly in the Handover Certificate.
The Recipient is required to deliver the signed Handover Certificate to the Provider within 3 days of its signature by fax or e-mail and the original within 7 days from the date of its signature.
A relevant User Guide will be provided to the Purchaser on receipt by FMSL of the Completion and Handover Certificate referred to under clause 10 above.
