Hosted Services Defect definition
Hosted Services Defect means a defect, error or bug in the Platform having an adverse effect on the appearance, operation, functionality or performance of the Hosted Services, but excluding any defect, error or bug caused by or arising as a result of:

Hosted Services Defect means a defect, error or bug in the Platform having a material adverse effect on the appearance, operation, functionality, or performance of the Hosted Services, but excluding any defect, error or bug caused by or arising as a result of:
i. any act or omission of the Company, Customer or any person authorised by the Customer to use the Platform or Hosted Services in accordance with the agreement; ii. any use of the Platform or Hosted Services contrary to the Documentation, whether by the Customer or by any person authorised by the Customer; iii. a failure of the Customer to perform or observe any of its obligations in this Agreement; and/or
1) an incompatibility between the Platform or Hosted Services and any other system, network, application, program, hardware, or software not specified as compatible in the Hosted Services Specification;
2) errors, defects, or changes to any third party software, hardware or services that are beyond the control of the Company;
Examples of Hosted Services Defect in a sentence
SPINWELL-GLU may, upon the request of Customer, provide support in respectof any problem that is not a Hosted Services Defect, but may charge Professional Service Charges in respect of such support.
SPINWELL-GLU may also charge Professional ServicesCharges for all time reasonably spent and all expenses reasonably incurred by it in order to verify that a problem reported to it by Customer is not a Hosted Services Defect.
In particular, the said warranties shall not apply to the extent that any Hosted Services Defect or Software Defect arose or was exacerbated as a result of any of the matters listed in CLAUSE 7.3.1 to 7.3.4.

(a) any act or omission of the Customer or any person authorized by the Customer to use the Platform or Hosted Services;
(b) any use of the Platform or Hosted Services contrary to the Documentation, whether by the Customer or by any person authorized by the Customer;
(c) a failure of the Customer to perform or observe any of its obligations in this Agreement; and/or
(d) an incompatibility between the Platform or Hosted Services and any other system, network, application, program, hardware or software not specified as compatible in the Hosted Services Specification;
Hosted Services Defect means a defect, error or bug in the Platform having a material adverse effect on the appearance, operation, functionality or performance of the Hosted Services, but excluding any defect, error or bug caused by or arising as a result of: any act or omission of the Customer or any person authorised by the Customer to use the Platform or Hosted Services; any use of the Platform or Hosted Services contrary to the Documentation, whether by the Customer or by any person authorised by the Customer; a failure of the Customer to perform or observe any of its obligations in the Agreement; and/or an incompatibility between the Platform or Hosted Services and any other system, network, application, program, hardware or software not specified as compatible in the Hosted Services Specification;
Hosted Services Defect means any failure of the SPINWELL-GLU Software to conform in all material respects to the Documentation relevant to the particular SPINWELL-GLU Software, but shall exclude all such non-conformities caused by any of the following:
1.39.1. any act or omission of the Customer or any person authorised by the Customer to use the Platform or Hosted Services; 1.39.2. any use of the Platform or Hosted Services contrary to the Documentation, whether by the Customer or by any person authorised by the Customer;
