Individual Relief definition

Individual Relief means Monetary Relief, and/or an offer of Settlement Promotion as defined in this Consent Decree, which a Claimant may receive pursuant to the terms of this Consent Decree.

Individual Relief under this Agreement means:

Individual Relief means relief from surcharges for excess consumption of agency purchased utilities due to special factors affecting utility usage not within the control of the resident, as the agency shall deem appropriate.

Examples of Individual Relief in a sentence

• If the Court determines that the Proposed Individual Relief Lists (as submitted by the United States pursuant to Paragraph 38, or as amended by the Court pursuant to Paragraph 48, are fair, adequate, reasonable, and consistent with federal law and consistent with this Consent Decree, the Court shall approve the Individual Relief to Claimants at or after the Fairness Hearing on Individual Relief.

• A Claimant’s failure to return an executed Acceptance of Individual Relief and Release of Claims Form by the deadline set forth in Paragraph 52 shall constitute a rejection and forfeit by the Claimant of the Individual Relief approved by the Court and shall release the Parties from any further obligation under the Consent Decree to provide Individual Relief to the Claimant.

• No later than sixty (60) days before the date set for the Fairness Hearing on Individual Relief, the United States will send, to the last known mailing address by first class U.S. Mail and last known email address, a Notice of Individual Relief Fairness Hearing Documents to each person who submitted an interest in relief form.

• Acceptance of Individual Relief and Release of Claims Form in the form set forth in Appendix 4.

• A Letter to Claimants, in the format attached as Appendix 3 (Part 1), to PAG and PNAG Claimants, informing each Claimant of the Individual Relief for which the Claimant has been found eligible, as well as the reasons for which the Claimant was found ineligible for any particular Individual Relief sought.

More Definitions of Individual Relief

Individual Relief under this Agreement means Back Pay Relief and/or Priority Hir- ing Relief as defined in this Section.

Individual Relief under this Decree means:

Individual Relief means the three tiers of potential relief to be distributed to Settlement Class Members as set forth below in paragraphs 4.03 through 4.05, and the associated claim forms.

Individual Relief means the following relief that a claimant may be offered pursuant to this Decree: (i) a monetary award in the form of backpay; and/or (ii) an offer of priority hire with retroactive hire date (as defined herein) (a recipient of such relief is a “priority hire”); and/or (iii) a retroactive hire date for a claimant whom the City hired between 2005 and 2011 and who is presently a City police officer (a “delayed hire”).
