In any interrogation conducted by the Police Department Internal Investigation Section or similar Police Department unit, a member shall have the right to tape record his entire interrogation, including comments prior to and following the actual questioning.
The FOP shall be permitted to provide and store a tape recorder and tapes in the Internal Investigation Section for the use of any member who is being interrogated, or the member may provide his own recorder and tapes.
Any anonymous complaint against a member received by the Internal Investigation Unit shall not be the sole basis for an investigation of a member.
To the Company’s Knowledge, no litigation, including any class action litigation or an effort to certify a litigation class, is currently underway in connection with the facts and circumstances reviewed under the Internal Investigation, including, without limitation, the Restatement.
