Design-Builder shall provide management for the Work in accordance with the organization chart set forth in Exhibit A – Schedule 3.2.2. Design-Builder acknowledges the importance of its Design-Build Project Manager, Design Manager/Coordinator, Energy Performance / Sustainable Design Specialists, Lead Designer and Project Superintendent (collectively, “Key Personnel”).
The Detailed Design shall be signed off by the by Lead Designer with an ECSA Professional Registration (Pr Eng/Pr Tech Eng), appropriate experience as detailed in the Functionality under the Tender Section.
TxDOT discourages changes in Key Personnel from the individuals listed in the QS and is under no obligation to approve such requests and may disapprove the request at its sole discretion; provided however, TxDOT will consider requests for a change in the Environmental Compliance Manager, which position is no longer required to be filled by an employee of the Lead Contractor or Lead Designer but is required to meet additional requirements as specified in Section 4.4.1 of the Technical Provisions.
The Contractor shall, prior to commencing the construction of the Temporary Works, submit a certificate to the Engineer, based on the ‘Design Certificate' signed by the Lead Designer and the Lead Design Checker, certifying that the Temporary Works have been properly and safely designed and checked, and that the Contractor has checked the effect of the Temporary Works on the Permanent Works and has found this to be satisfactory.
To the extent not directly covered as insureds by the project-specific policies described above, the Design-Builder will cause each other Subcontractor or subconsultant (other than the Lead Designer) providing professional services to procure and keep in force professional liability insurance as specified below, which coverage must be maintained for 3 years after completion of the relevant professional service.
