Lease Sweep Lease definition

Lease Sweep Lease means (i) the PUREgraphite Lease, or (ii) any replacement Lease that, either individually, or when taken together with any other Lease with the same Tenant or its Affiliates, and assuming the exercise of all expansion rights and all preferential rights to lease additional space contained in such Lease, covers the majority of the applicable Lease Sweep Space.
Lease Sweep Lease means (i) that certain Commercial Lease dated August 30, 2016 by and between J Square Realty and Development Corp. and Starbucks Corporation, as the same may be amended, supplemented or otherwise modified from time to time in accordance with this Agreement (the “Starbucks Lease”); (ii) that certain Building Lease dated July 18, 2012 by and between ZS14, LLC and 7-Eleven, Inc., as the same may be amended, supplemented or otherwise modified from time to time in accordance with this Agreement (the “7-Eleven Lease”); (iii) that certain Lease Agreement dated September 24, 2003 by and between Greenbrier Partners, LLC and CTA, Inc., as the same may be amended, supplemented or otherwise modified from time to time in accordance with this Agreement (the “Xxxxx & Whitney Lease”); or (iv) any replacement Lease that, either individually, or when taken together with any other Lease with the same Tenant or its Affiliates, and assuming the exercise of all expansion rights and all preferential rights to lease additional space contained in such Lease, covers the majority of the applicable Lease Sweep Space.
Lease Sweep Lease means (i) that certain Lease dated as of January ___, 2018, as it may be amended from time to time, by and between MVP Hawaii, as landlord, and SP Plus Corporation, a Delaware corporation, as tenant, (ii) that certain Lease dated as of August 19, 2015, as it may be amended from time to time, by and between MVP City Park, as landlord, and ABM Onsite Services – Midwest, Inc., a Delaware corporation, as tenant, (iii) that certain Lease dated as of February 1, 2018, as it may be amended from time to time, by and between MVP New Orleans, as landlord, and 342 N. Rampart, L.L.C., a Louisiana limited liability company, as tenant (the "New Orleans Lease"), (iv) that certain Master Commercial Lease with Respect to TTU Sublease and TTU Premises dated as of November 16, 2017, as it may be amended from time to time, by and between MVP Raider Park, as landlord, and Xxxx Maintenance Company, LLC, a Texas limited liability company, as tenant, (v) that certain Master Commercial Lease Excluding the TTU Sublease and TTU Premises dated as of November 16, 2017 (the "Xxxx Non‑TTU Lease"), as it may be amended from time to time, by and between MVP Raider Park, as landlord, and Xxxx Maintenance Company, LLC, a Texas limited liability company ("Xxxx"), as tenant, and (vi) any other Lease which has a gross annual rent of more than fifteen percent (15.0%) of the aggregate total annual Rents of the Properties.

  • There is no material fact presently known to Borrower which adversely affects, nor as far as Borrower can foresee, would be reasonably likely to adversely affect, the Property or the business, operations or condition (financial or otherwise) of Borrower or Guarantor, including any Lease Sweep Lease or any Tenant under any Lease Sweep Lease.

  • There is no material fact presently known to Borrower which adversely affects, nor as far as Borrower can foresee, might adversely affect, the Property or the business, operations or condition (financial or otherwise) of Borrower or Guarantor, including any Lease Sweep Lease or any Tenant under any Lease Sweep Lease.

  • Borrower shall notify Lender (i) of receipt of any notice from any Tenant under a Lease Sweep Lease of its intention to discontinue its business at its Lease Sweep Space at the Property (or any material portion thereof) within five (5) Business Days after receipt from the applicable Tenant and (ii) of any default under a Lease Sweep Lease that continues beyond any applicable notice and cure periods, within five (5) Business Days after the expiration of such applicable notice and cure periods.

  • Notwithstanding the above, on or prior to twenty-four (24) months prior to the earliest stated expiration of the Iowa College Lease (i.e., December 31, 2019) or any applicable Lease Sweep Lease, Borrower shall have the option to deposit into the Lease Sweep Account either in cash, Letter of Credit or any combination of cash and Letter of Credit such amounts which equal the Lease Sweep Account Maximum Amount.

  • Any such disbursement of more than $25,000 to pay (rather than reimburse) Approved Lease Sweep Lease Leasing Expenses or Approved Leasing Expenses (as the case may be) may, at Lender’s option, be made by direct check payable to the payee of such Approved Lease Sweep Lease Leasing Expenses or Approved Leasing Expenses (as the case may be).

  • Borrower shall promptly notify Lender of any written notice sent or received by Borrower regarding (A) the occurrence or continuance of a default under any Lease that would reasonably be expected to result in a Material Adverse Effect, (B) the early termination, early cancellation or early surrender of the premises demised under any Lease Sweep Lease (or any material portion thereof), and (C) the renewal, replacement, expiration or termination of the Bloomberg Letter of Credit.

  • There is no material fact presently known to Guarantor which has not been disclosed to Lender which adversely affects, nor as far as Guarantor can foresee, might adversely affect, the Property, the business, operations or condition (financial or otherwise) of Borrower or Guarantors, including any Lease Sweep Lease or any Tenant under any Lease Sweep Lease.


More Definitions of Lease Sweep Lease

Lease Sweep Lease means the Overstock Lease, and any other Lease which covers 50,000 or more rentable square feet of the Improvements.
Lease Sweep Lease means (i) that certain Lease Agreement by and between Borrower’s predecessor in interest, as landlord, and BROAD RIVER RETAIL, LLC, a North Carolina limited liability company, through its predecessor in interest, as tenant, dated as of December 30, 2005, as the same may have been amended and may further be amended, supplemented or otherwise modified from time to time in accordance with this Agreement (the “Ashley Furniture Lease”), (ii) that certain Commercial Lease by and between Borrower, as landlord, and GASTONIA ATP, LLC, a North Carolina limited liability company, as tenant, dated as of May 8, 2018, as the same may have been amended and may further be amended, supplemented or otherwise modified from time to time in accordance with this Agreement (the “Altitude Trampoline Park Lease”) or (iii) any replacement Lease that, either individually, or when taken together with any other Lease with the same Tenant or its Affiliates, and assuming the exercise of all expansion rights and all preferential rights to lease additional space contained in such Lease, covers the majority of the applicable Lease Sweep Space.

Related to Lease Sweep Lease

  • Operating Lease means, as applied to any Person, any lease (including, without limitation, leases which may be terminated by the lessee at any time) of any Property (whether real, personal or mixed) which is not a Capital Lease other than any such lease in which that Person is the lessor.

  • Space Lease The space or occupancy lease pursuant to which any Borrower holds a leasehold interest in the related Mortgaged Property, together with any estoppels or other agreements executed and delivered by the lessor in favor of the lender under the related Mortgage Loan(s).

  • Ground Lease means a lease creating a leasehold estate in real property where the fee owner as the ground lessor conveys for a term or terms of years its entire interest in the land and buildings and other improvements, if any, comprising the premises demised under such lease to the ground lessee (who may, in certain circumstances, own the building and improvements on the land), subject to the reversionary interest of the ground lessor as fee owner. With respect to any Mortgage Loan where the Mortgage Loan is secured by a Ground Leasehold estate in whole or in part, and the related Mortgage does not also encumber the related lessor’s fee interest in such Mortgaged Property, based upon the terms of the Ground Lease and any estoppel or other agreement received from the ground lessor in favor of Mortgage Loan Seller, its successors and assigns (collectively, the “Ground Lease and Related Documents”), Mortgage Loan Seller represents and warrants that:

  • Tenant Lease means any lease entered into by the Borrower, any Loan Party or any Subsidiary with respect to any portion of a Property.

  • the Lease means the lease of the said land to be granted by the Lessor to the Lessee pursuant to clause 2.1;

  • Sub-Lease means the sub-lease entered into following the approval of an Approved Sub-lease;

  • Lease contract means the total legal obligation that results from the lease agreement as affected by this article and any other applicable rules of law. Unless the context clearly indicates otherwise, the term includes a sublease contract.

  • Lease Supplement means a Lease Supplement, substantially in the form of Schedule 2 hereto, to be entered into between Lessor and Lessee on the Delivery Date for the purpose of leasing the Aircraft under and pursuant to the terms of this Agreement, and any subsequent Lease Supplement entered into in accordance with the terms of this Agreement.

  • New Lease Any lease of REO Property entered into on behalf of REMIC I, including any lease renewed or extended on behalf of REMIC I, if REMIC I has the right to renegotiate the terms of such lease.

  • Lease Agreement means the bargain, with respect to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this article.   • Sublease means a lease of goods the right to possession and use of which was acquired by the lessor as a lessee under an existing lease.

  • Base Lease means the Base Lease Agreement delivered concurrently with this Lease between the Company and the Issuer.

  • Occupancy Agreement means a written agreement entered into between an assisted living program and a tenant that clearly describes the rights and responsibilities of the assisted living program and a tenant, and other information required by rule. “Occupancy agreement” may include a separate signed lease and signed service agreement.

  • Master Leases means the PropCo Master Leases and each other Material Master Lease.

  • Master Lease Agreement has the meaning set forth in Section 7.2(c)(xiv).

  • Operating Lease Expense means the sum of all payments and expenses incurred by a Person, under any operating leases during the period of determination, as determined in accordance with GAAP.

  • Mining Lease means the mining lease granted pursuant to Clause 12 and includes any renewal thereof and according to the requirements of the context shall describe the area of land demised as well as the instrument by which it is demised;

  • Landlord Agreement means an agreement substantially in the form provided by Lender to Borrower or such other form as Lender may agree to accept.

  • Major Lease shall have the meaning assigned to such term in the Mortgage Loan Agreement.
