Licensed Product or Service means any past, current or future apparatus, system, device, hardware, software, method, product or service or any component or portion thereof that is designed, branded, made, used, sold, offered for sale, leased, purchased, licensed, imported, exported, supplied or otherwise provided by, for, to, on behalf of, or for the benefit of Paragon or a Paragon Affiliate, which (a) comes within the scope of any claim of the patents in or issuing from the Licensed Intellectual Property, (b) absent the licenses, covenants and releases of this Agreement, would infringe at least one of the patents in or issuing from the Licensed Intellectual Property under 35 USC § 271, including §§ 271 (a), (b), (c), (f) and (g); or (c) uses the Alleged Technical Trade Secrets

Examples of Licensed Product or Service in a sentence

  • A PatentBook Subscriber (Licensee) License becomes effective and Subscription Payment Obligation is incurred when a Subscriber (Licensee) sells any Licensed Product or Service.

Related to Licensed Product or Service

  • Licensed producer means a person or entity licensed to produce medical cannabis.

  • Licensed Product means a product, method or service in the Licensed Field of Use, the making, having made, using, importing or selling of which, absent this license, infringes, induces infringement, or contributes to infringement of a Licensed Patent.

  • Licensed Service means performance of a service for any consideration using a Licensed Product, or the practice of a Licensed Process. For clarity, research and development of Licensed Products by Licensee, its Affiliates, or a Sublicensee does not constitute a Licensed Service.

  • Licensed Products means tangible materials which, in the course of manufacture, use, sale, or importation, would be within the scope of one or more claims of the Licensed Patent Rights that have not been held unpatentable, invalid or unenforceable by an unappealed or unappealable judgment of a court of competent jurisdiction.

  • Product means any deliverable under the Contract, which may include commodities, services, technology or software.

  • Combination Product means a product that includes a device for delivery or at least one active ingredient other than a Licensed Product.
