Management district plan or “plan” means a proposal as defined in Section 36622.

• This Agreement may be supplemented, amended or modified only by mutual agreement of the parties; however, this Agreement shall be subject to any amendments to the MHTBID Management District Plan adopted by the City Council pursuant to the 1994 Law.

• By July 1, beginning with fiscal year 2009-2010, an annual report detailing a work program and itemized budget for the current fiscal year that conforms to the Management District Plan and Section 36650 of the Code.

• Corporation will use its best efforts to implement and complete all District Programs specified in the Management District Plan and Annual Reports; however, it is possible that Corporation may not expend the precise amount budgeted for any particular line item in Corporation's annual budget.

• All outstanding Assessment Funds collected after disestablishment shall be spent on Improvements and Activities specified in the Management District Plan in accordance with Section 36671 of the Streets and Highways Code.

• Each property-related service, Improvement and Activity specified in the Management District Plan, and included in the budget therein during the first Fiscal Year of operations and in the corresponding Annual Report for subsequent Fiscal Years, shall be implemented by Corporation.
