Medical Confidentiality definition

Medical Confidentiality. The Parties shall adhere to the principles of medical confidentiality in relation to Clinical Trial Subjects. The Medical Records and any other Personal Data of a Clinical Trial Subject shall not be disclosed to the Sponsor by the Clinical Organisation, save where necessary in any of the following circumstances: to the extent that the disclosure is required to satisfy the requirements of the Protocol; for the purpose of monitoring, auditing or adverse event reporting or investigation; for the purposes of investigation or defending any claim or proceeding brought by a Clinical Trial Subject in connection with the Clinical Trial; and for the purpose of allowing the Sponsor to follow-up with the Clinical Trial Subject after the conclusion of the Clinical Trial. The Sponsor shall not disclose the identity of any Clinical Trial Subject to any third party save in accordance with Data Protection Laws and Guidance or as required by law, and the Clinical Organisation and the relevant Clinical Trial Subject shall be notified by Sponsor of such intended disclosure prior to such disclosure being made, unless the Sponsor is otherwise prohibited from doing so in accordance with law. Clinical Trial Subject Consent: The explicit consent of each Clinical Trial Subject shall be obtained by the Clinical Organisation in accordance with applicable laws, the Protocol, HSE consent Policy, the Informed Consent Form (“ICF”) and the Patient Information Leaflet (“PIL”) provided by the Sponsor to the Clinical Organisation for provision to the Clinical Trial Subject, or to the Clinical Trial Subject directly, for their participation in, and the processing of their Personal Data for the purposes of, the Clinical Trial.
Medical Confidentiality means relationship of trust existing or which should exist between a patient and his/her doctor or any health agent, paramedical staff, health worker, laboratories, pharmacies or people of similar status (PLHIV) as well as any person whose professional or official prerogatives allow him/her to have access to such information.

  • Confidentiality means that only people who are authorised to use the data can access it.

  • Confidential Information Breach means, generally, an instance where an unauthorized person or entity accesses Confidential Information in any manner, including but not limited to the following occurrences: (1) any Confidential Information that is not encrypted or protected is misplaced, lost, stolen or in any way compromised; (2) one or more third parties have had access to or taken control or possession of any Confidential Information that is not encrypted or protected without prior written authorization from the State; (3) the unauthorized acquisition of encrypted or protected Confidential Information together with the confidential process or key that is capable of compromising the integrity of the Confidential Information; or (4) if there is a substantial risk of identity theft or fraud to the client, the Contractor, the Department or State.

  • Confidentiality Agreement has the meaning set forth in Section 6.3.
