Private life definition

Private life means the personal and family life of a person, his living environment consisting of a person’s dwelling with its private territory and other private premises which the natural person uses for his economic, commercial or professional activities as well as the mental and physical inviolability of the natural person, his honour and reputation, secret personal facts, the natural person’s photographs or other images, his personal health information, private correspondence or other communications, personal views, convictions, habits and other data which may be used only with his consent.
Private life means any material reflecting the private relations of a consumer, place of his personal business activities, personal records, correspondence, telephone conversations, etc.; (9.11.2007 No 7)
Private life is a very broad and by no means exhaustive notion. Doctrine and jurisprudence generate from time to time and case by case new elements that can be included in the private life of legal entities and this in fact makes the work of the judicial system very difficult in guaranteeing and respecting this right and identifying violations presumed in this respect. If we are to make a detailed analysis of this vocabulary, we must first dwell on the word “life”4, which means the existence of man or individual5. So the provision itself respects the right to life, the right to live, to exist, despite the fact that this right does not seem to be the main right or purpose at first sight of the interpretation of Article 8 of the ECHR we must accept that without the existence of respect for this right would not exist other rights either. Seen in this light despite the fact that the right to life is not the primary focus of this provision it remains its essence.
