Net Settlement Funds definition

Net Settlement Funds means, for each class action identified in paragraph 1, the aggregate of the Settlement Amounts recovered pursuant to the Settlement Agreements, plus accrued interest, less:

Net Settlement Funds means the Net Settlement Funds - Fixed and the Net Settlement Funds - Claimable;

Net Settlement Funds means the Settlement Amount less Class Counsel Fees, Class Counsel Disbursements, and Settlement Administration Expenses;

Examples of Net Settlement Funds in a sentence

• In such an event, no Net Settlement Funds will be distributed to Claimants with Approved Claims for Cash Fund Payments.

• In such an event, no Net Settlement Funds will be distributed to Claimants for Approved Claims for Documented Loss Payments or for Cash Fund Payments.

• However, if you exclude yourself from the Settlement Agreements, you will not be eligible to share in the Net Settlement Funds.

• If you did not submit a timely proof of claim and release pursuant to the 2016 Notice, then, in order to participate in and receive your share of the Net Settlement Funds, you must submit a valid and timely Proof of Claim and Release demonstrating that you are an Authorized Claimant as set forth in the Deutsche Bank Settlement Agreement and the JPMorgan Settlement Agreement.

• The precise method of calculating the distribution of the Net Settlement Funds in respect of the Class Members’ transactions will be determined in accordance with a Distribution Plan that will be formulated and proposed to the Court by Class Counsel.

More Definitions of Net Settlement Funds

Net Settlement Funds means the aggregate of the Settlement Amounts recovered pursuant to the Settlement Agreements, plus accrued interest, less:

Net Settlement Funds means the balance after all Fees have been deducted from the Settlement Funds received on a Business Day;

Net Settlement Funds means the amount available from the Maximum Base Fund and Maximum Economic Loss Fund to be distributed to Settlement Class Members as Base Payments and Eligible Economic Loss Claim Payments and to pay any Excess Administration Expenses, after deducting the Class Counsel Fee, Class Counsel Disbursements, and Representative Plaintiff Honorarium;

Net Settlement Funds means the Escrow Settlement Funds after payment of Administration Expenses and Class Counsel Fees. For greater certainty, Net Settlement Funds includes the after tax amount of any accrued interest income earned on the Escrow Settlement Funds; and

Net Settlement Funds means the Net Settlement Funds –Fixed and the Net Settlement Funds – Claimable, as defined in the Settlement Agreement.

Net Settlement Funds means the amount of the Settlement Funds after adjustment for the payment of Court- approved litigation expenses, costs of settlement administration, attorneys’ fees, and class representative incentive awards.

Net Settlement Funds means funds payable to Program Merchants to settle Charges, net of Chargebacks, Discount, Credits, and any other applicable fees or amounts owed to American Express under this Agreement. New Program Merchant bas the meaning given in Schedule 4.
