New Note Documents definition

New Note Documents means, collectively, the Senior Note Documents and the Senior Subordinated Note Documents.

New Note Documents means the New Notes Indenture and the New Notes, as each such document may be amended, restated, supplemented or otherwise modified from time to time.

New Note Documents means each document or agreement relating to the issuance of the New Notes.

• The monetary obligations of the Loan Parties under this Agreement and the other Loan Documents constitute "Senior Indebtedness" of such Person under and as defined in the New Note Documents.

More Definitions of New Note Documents

New Note Documents means, collectively, the Securities Purchase Agreement, the Stock Pledge Agreement, the Master Security Agreement, the Funds Escrow Agreement, the Subordination Agreement, the Assignment of Monies Due and to Become Due and the Registration Rights Agreement, each to be entered into by and among Laurus, Acquisition Sub, Cyber Digital and the other Persons party thereto in connection with the New Note.

New Note Documents means the New Notes Indenture and these Heads of Terms.

New Note Documents means the indentures under which the New Senior Unsecured Notes and the Subordinated PIK Notes are issued and all other instruments, agreements and other documents evidencing or governing the New Senior Unsecured Notes and the Subordinated PIK Notes or providing for any Guarantee or other right in respect thereof.

New Note Documents means the New Indenture, the New Notes, the Guarantees, the Collateral Agreements, and any other agreements governing, securing or relating to any New Note Obligations.

New Note Documents means, collectively the New Notes Indenture, the New Second Lien Notes, the New Notes Guarantees and the new security documentation to be entered into pursuant to the New Notes Indenture, in each case, in form acceptable to the Applicants and substantially on the terms as described in the Circular, as such terms may be amended pursuant to the Plan;

New Note Documents means this Agreement, the New Notes and the New Note Guarantee.

New Note Documents means the New Note and the Security Documents, and any other documents and agreements executed and delivered in connection therewith.
