NNN Charges definition

NNN Charges shall have the meaning set forth in Section 2.7 hereof.

  • Further, all charges to be paid by Tenant hereunder, including, without limitation, payments for NNN Charges, shall be considered "additional rent" for the purposes of this Lease, and the word "rent" in this Lease shall include such additional rent unless the context specifically or clearly implies that only the Basic Rent is referenced.

  • Inland and Manager (as defined in Section 2.11 hereof) shall make a final reconciliation of 2004 NNN Charges on or before April 30, 2005.

  • In the event that any final audit report reflects that Landlord has overstated NNN Charges by more than 5%, Landlord shall reimburse Tenant for the reasonable costs of such audit, not to exceed $2,500.00.

  • If Tenant holds over, Tenant becomes a tenant-at-will and Minimum Monthly Rent and NNN Charges shall automatically increase by 50%.

  • Tenant shall pay, as additional rent, such estimated expenses as part of the NNN Charges concurrent with its payment of Basic Rent.


More Definitions of NNN Charges

NNN Charges means Tenant's proportionate share (based on the square footage of the Premises divided by the total square footage of all building area in the Shopping Center leased or available for lease is 58,731 SF) of all charges and expenses paid or incurred in good faith by Landlord in operating, supervising, managing, administering, maintaining, repairing, replacing, insuring, and paying taxes and insurance on, the Shopping Center, including such reasonable reserves against future such expenses as Landlord deems necessary or advisable. NNN Charges do not, however, include expenses for which Landlord is otherwise reimbursed or indemnified (for example, losses covered by insurance); principal or interest on any encumbrance; tenant improvements or leasing commissions; or overhead and administrative costs of Landlord not directly incurred in the operation and maintenance of the Shopping Center. Tenant portion of expenses shall be calculated at 12.57% of total CAM expenses each year. All and any services or management performed in connection with the Shopping Center may be provided by independent contractor(s). Within ninety (90) days after the end of each calendar year of the Lease term, Landlord shall deliver to Tenant a statement setting forth, in reasonable detail, the Building Expenses paid or incurred by Landlord during the preceding calendar year and Tenant's pro rata share thereof. Upon receipt of such statement, there shall be an adjustment between Landlord and Tenant, with payment to or credit given by Landlord (as the case may be) so that Landlord shall receive the entire amount of Tenant's pro rata share of such costs and expenses for such period. Current expenses are estimated at $1.35 per SF, which includes CAM, Taxes and Insurance. The Landlord hereby warrants and represents that the NNN expense currently being charged to the Tenant is sufficient to cover all additional expenses being assessed to the Tenant. The Landlord further represents there have been no special assessments charges to the tenant of the premises during the last 5 years.
NNN Charges. The initial estimated NNN Charges are Nine Thousand Eight Hundred and 50/100 ($9,800.50) per month (capped at $0.10 per sq. ft. per month for the first year) payable on the first day of each month. NNN charges for the period of July 1, 2004 through July 31, 2004 shall be paid upon execution of this Lease. (See also Paragraph 4)

  • SLDC Charges means the charges levied by the SLDC of the state wherein the Solar Power Project is located;

  • Service Charges means the fees levied by the municipality in terms of its tariff policy for any municipal services rendered in respect of an immovable property and includes any penalties, interest or surcharges levied or imposed in terms of this policy.

  • Contract Charges means charges that accrue during a given month as defined in Article III. “Contract Term” is defined in Article IV.

  • Utility Charges means water, sewer, electricity, gas and other utility charges, if any, applicable to the Real Property or the Leased Real Property;

  • Bond Service Charges means, for any period or payable at any time, the principal of, premium, if any, and interest on the Bonds for that period or payable at that time whether due at maturity or upon redemption, Mandatory Tender or acceleration.

  • Rental Charges means the charges payable for renting the Vehicle from Us together with GST and any other taxes or levies which are all fully set out in the Rental Agreement.

  • Debt Service Charges means for any Measurement Period, the sum of (a) Consolidated Interest Charges paid or required to be paid for such Measurement Period, plus (b) principal payments made or required to be made on account of Indebtedness (excluding the Obligations and any Synthetic Lease Obligations but including, without limitation, Capital Lease Obligations) for such Measurement Period, in each case determined on a Consolidated basis in accordance with GAAP.

  • Termination Charges means any compensatory charges payable by the Customer to BT on termination of this Agreement in whole or in part or a Service as set out in a Schedule or Order.

  • Usage Charges means the Charges for the Service or applicable part of the Service that are calculated by multiplying the volume of units that the Customer used or incurred in a period (e.g. number of users using the Service, or the number of minutes the Service was used for) with the relevant fee that is specified in the Online Order.

  • Total Service Charges means all charges, after application of all discounts and credits, for Services excluding Taxes, Governmental Charges, equipment, Company ILEC, Company Wireless, Document Delivery Fax, non-recurring, goods and services acquired by Company as Customer’s agent, international pass-through access (Type 3/PTT) and charges for international access or provided by Company (Type 1), charges for security services provided by Cybertrust, Inc. or its affiliates set forth in the Guide as providers of Cybertrust security services and other charges expressly excluded by this Agreement.

  • Hire Charges means the rates and charges payable by You for the hire of the Equipment.

  • Room charge means the charge imposed for the use or occupancy of a room, excluding charges for food, beverages, state use tax, telephone service, or like services paid in connection with the charge, and excluding reimbursement of the assessment imposed by this act.

  • Installation Charges means those Charges set out in the Order in relation to installation of the Service and/or any Purchased Equipment, Customer Equipment and/or BT Equipment as applicable.

  • Delivery charges means charges by the seller of personal property or services for preparation and delivery to a location designated by the purchaser of personal property or services including, but not limited to, transportation, shipping, postage, handling, crating and packing. Delivery charges shall not include charges for delivery of direct mail if the charges are separately stated on an invoice or similar billing document given to the purchaser.

  • Maintenance Charges means the charges payable by the applicant to the Maintenance Agency in accordance with the demand raised by the Maintenance Agency for the maintenance and up keep of the said building/ said complex, including common areas and facilities but does not include; (a) the charges for actual consumption of utilities in the Dwelling Unit including but not limited to electricity, water, which shall be charged based on actual consumption on monthly basis and (b) any statutory payments, taxes, with regard to the Dwelling Unit/ said building/said complex.

  • Individual Charges means those charges incurred by individual Attendees including, but not limited to, restaurant charges other than the allowable group meals specified herein, any charge for alcoholic beverages, telephone expenses, sleeping room rental deposits, upgrades, Cancellation Fee and/or other applicable service or cancellation charges incurred by an Attendee, and associated taxes, surcharges, and/or other incidentals.

  • Governmental Charges has the meaning set forth in Section 9.2.

  • Cancellation Charges means collectively (i) the Booking Amount; (ii) all interest liabilities of the Allottee accrued till date of cancellation; and (iii) brokerage paid to real estate agent/channel partner/broker, if any (iv) the stipulated charges on account of dishonour of cheque; (v) administrative charges as per Promoter’s policy and (vi) amount of stamp duty and registration charges to be paid/paid on deed of Cancellation of this Agreement
