CAM Expenses definition

CAM Expenses. As defined in Section 10.2(c)(ii).
CAM Expenses shall have the meaning set forth in Section 4.02B hereof.
CAM Expenses means any costs and expenses incurred by Landlord or any 43 Landlord Entity with respect to the ownership, operation, maintenance, repair and/or replacement of any 44 portions of the World Trade Center (other than the Land and the Building) and any facilities or areas 1 outside of the Real Property, including any such costs and expenses incurred pursuant to the REOA and 2 any costs paid by Landlord under the REOA.

Examples of CAM Expenses in a sentence

  • Landlord may cause any or all of such services to be provided by third parties and the cost of such services shall be included in CAM Expenses.

  • Landlord shall furnish adequate hot and cold water at standard Building temperatures to the Building for drinking, lavatory and cleaning purposes, the cost of which shall be included in Landlord’s CAM Expenses.

  • While a non-food use tenant may often require an exclusion from CAM Expenses for costs relating to operation of a food court or patio eating area or similar expenses benefiting only certain of the occupants of the Shopping Center, the landlord must conversely remember to allow for cost pooling, whereby the landlord retains the right to allocate certain CAM Expenses only among those occupants of the Shopping Center benefiting from the applicable expense.

  • Equal to one (1) month's installment of base rent and CAM Expenses.

  • From the tenant’s perspective, the best mechanism when seeking to avoid unanticipated CAM Expenses is to obtain a “cap” or limitation on the tenant’s obligation for payment of CAM Expenses (which is typically structured as a maximum limit on first year CAM Expenses with a percentage-based limit on subsequent annual increases).


More Definitions of CAM Expenses

CAM Expenses means common operating costs and expenses, including without limitation insurance, real estate taxes, certain capital items customarily payable by shopping center tenants (such as parking lot repaving), and an administrative fee, payable by Tenants under Leases.
CAM Expenses means all direct and indirect costs and expenses paid or incurred by Landlord in connection with the ownership, management, operation, maintenance, replacement, and repair of the Property or providing services in accordance with this Lease including without limitation Section 6.1 below and, including, but not limited to, all utilities; management fees and expenses; snow and ice and mud removal (if ever applicable); maintenance of the fire suppression systems, if any; accounting and other professional fees and expenses; painting the exterior of the Property or any structures; maintaining and repairing the foundations, the exterior walls and roof, the parking and loading areas, the sidewalks, landscaping and common areas, and the other parts of the Property; costs and expenses required by or resulting from compliance with any laws, ordinances, rules, regulations or orders applicable to the Property; and costs and expenses of contesting by appropriate proceedings any matter concerning managing, operating, maintaining, replacing or repairing the Property, or the validity or applicability of any law, ordinance, rule, regulation or order relating to the Property, or the amount or validity of any Property Taxes. CAM Expenses shall not include Property Taxes, Insurance Costs, charges payable by Tenant pursuant to Section 3.5 hereof, depreciation on the Property, costs of tenants’ improvements, real estate brokers’ commissions, interest, or capital costs for major roof or major parking lot replacement or restoration work necessitated by fire or other casualty damage to the extent of net insurance proceeds received by Landlord with respect thereto.
CAM Expenses means all payments actually made by a Seller for common area maintenance charges which are charged to or payable by tenants under applicable Leases, and which shall be shown on the CAM Proration Statement. Unpaid invoices and other amounts due for CAM Expenses shall be prorated as of the Statement Date based on a 365-day year, Sellers will not receive a credit for any CAM Expenses as to which there has not been a corresponding CAM Collection.

CAM Expenses shall not include Property Taxes. CAM Expenses means all costs and expenses paid or incurred by Landlord in connection with the ownership, management, operation, maintenance or repair of the Premises, the Building and the Project or providing services in accordance with this Lease, including but not limited to the following, to the extent that each relates to the ownership, management, operation, maintenance and repair of the Premises, the Building and the Project; permit and inspection fees; electricity, gas, fuel, steam, heat, light, power, water, sewer and other utilities; management fees equal to three percent (3%) of net revenues (net revenues being gross revenues less (a) the management fee and (b) that portion of amortized Capital Costs attributable to the year in question) attributable to the Building and related expenses; security, guard (although Landlord shall be under no obligation to provide security or guard services), extermination, water treatment, garbage and waste disposal, rubbish removal, janitorial services, plumbing and other services; maintenance of the fire suppression systems; landscape maintenance; supplies, tools, materials and equipment; accounting and other professional fees and expenses; painting the exterior of the Project; maintaining and repairing the exterior walls and roof membrane, the parking and loading areas, the sidewalks, landscaping and common areas, and the other parts of the Project; costs and expenses required by or resulting from compliance with any laws, ordinances, rules, regulations or orders applicable to the Project; Capital Costs; annual interest on any portion of unpaid Capital Costs which are amortized, as provided below, at an interest rate equal to the rate specified in SECTION 3.4; and costs and expenses of contesting by appropriate proceedings any matter concerning managing, operating, maintaining or repairing the Project, or the validity or applicability of any law, ordinance, rule, regulation or order relating to the Project, or the amount or validity of any Property Taxes. CAM Expenses shall not include Property Taxes, Insurance Costs or charges payable by Tenant pursuant to SECTION 3.5 hereof, depreciation on the Project; the cost of Landlord's work undertaken by Landlord pursuant to EXHIBIT B; costs of tenants' improvements, real estate brokers' commissions, interest or principal on debt of Landlord; or restoration work necessitated by fire or other casualty damage to the extent of net insurance proceeds received by Landlord with respect th...
CAM Expenses means all costs of maintenance, inspection and repairs of the Common Areas of the Property, including, but not limited to, those costs for security, lighting, painting, cleaning, decorations and fixtures, Utilities, ice and snow removal, trash disposal, project signs, roof repairs, pest control, project promotional expenses, property owners' association dues, wages and salary costs of maintenance personnel, and other expenses benefiting all the Property that may be incurred by Landlord, in its discretion, including sales taxes and a reasonable service charge for the administration thereof. The term "Common Areas" is defined as that part of the Property intended for the collective use of all tenants including, but not limited to, the parking areas, driveways, loading areas, landscaping, gutters and downspouts, plumbing, electrical systems, HVAC systems, roof, exterior walls, sidewalks, malls, promenades (enclosed or otherwise), meeting rooms, doors, windows, corridors and public rest rooms. CAM Expenses do not include the cost of capital improvements, the cost of management office equipment and furnishings, depreciation on Landlord's original investment, the cost of tenant improvements, real estate brokers' fees, advertising of space for lease, or interest or depreciation on capital investments.
