No Release of Lessee. Regardless of Lessor's consent, no subletting or assignment shall release Lessee of Lessee's obligation or alter the primary liability of Lessee to pay the rent and to perform all other obligations to be performed by Lessee hereunder. The acceptance of rent by Lessor from any other person shall not be deemed to be a waiver by Lessor of any provision hereof. Consent to one assignment or subletting shall not be deemed consent to any subsequent assignment or subletting. In the event of default by any assignee of Lessee or any successor of Lessee, in the performance of any of the terms hereof, Lessor may proceed directly against Lessee without the necessity of exhausting remedies against said assignee. Lessor may consent to subsequent assignments or subletting of this Lease or amendments or modifications to this Lease with assignees of Lessee, without notifying Lessee, or any successor of Lessee, and without obtaining its or their consent thereto and such action shall not relieve Lessee of liability under this Lease.

Lessor may consent to amendments or modifications to this Lease with assignees of Lessee after notice thereof to Lessee if Lessee is still liable hereunder, and such action shall not relieve Lessee of liability under this Lease. No notice to Lessee of such amendments or modifications shall be required. Any permitted assignee shall assume the obligations of Lessee hereunder, by a writing satisfactory to Lessor, and a copy thereof shall be delivered to Lessor and to Lessee.

The acceptance of rent by Lessor from any other person shall not be deemed to be a waiver by Lessor of any provision hereof. Consent to one assignment or subletting shall not be deemed consent to any subsequent assignment or subletting.
No Release of Lessee. No subletting or assignment as approved by City shall release Lessee of Xxxxxx’s obligation or alter the primary liability of Lessee to pay the rent and to perform all other obligations by Xxxxxx hereunder. The acceptance of rent by City from any other person shall not be deemed to be a waiver by City of any provision hereof. In the event of default by any approved assignee or other successor of Xxxxxx in the performance of any of the terms hereof, City may proceed directly against Xxxxxx without the necessity of exhausting remedies against such assignee or successor.
No Release of Lessee. No assignment or subletting shall release the Lessee from any of the obligations set forth in this Lease.
No Release of Lessee. No consent by Lessor to any assignment or subletting by Lessee shall relieve Lessee of any obligation to be performed by Lessee under this Lease, whether occurring before or after such consent, assignment or subletting. The consent by Lessor to any assignment or subletting shall not relieve Lessee from the obligation to obtain Lessor's express written consent to any other assignment or subletting. The acceptance of rent by Lessor from any other person shall not be deemed to be a waiver by Lessor of any provision of this Lease or to be a consent to any assignment, subletting or other transfer. Consent to one assignment, subletting or other transfer shall not be deemed to constitute consent to any subsequent assignment, subletting or other transfer.
No Release of Lessee. No transfer permitted by this Article Eight whether with or without Lessor's consent, shall release Lessee or change Lessee's primary liability to pay the rent and to perform all other obligations of Lessee under this Lease. Lessor's acceptance of the rent from any other person is not a waiver of any provision of this Article Eight. Consent to one transfer is not a consent to any subsequent transfer. If Lessee's transferee defaults under this Lease, Lessor may proceed directly against Lessee without pursuing remedies against the Transferee. Lessor may consent to subsequent assignments or modifications of this Lease by Lessee's transferee, without notifying Lessee or obtaining its consent. Such action shall not relieve Lessee's liability under this Lease.

Lessor may consent to subsequent assignments or subletting of this Lease or amendments or modifications to this Lease with assignees. *Any profit, will be split 50/50 between Lessor and Lessee. Initials: /s/ RS ------- of Lessee, without notifying Lessee, or any successor of Xxxxxx, and without obtaining its or their consent thereto and such action shall not relieve Lessee of liability under this Lease.
