Noncommercial Use definition

Noncommercial Use means uses of the Data that meets the following two criteria: the use objectively (i) is used either for internal purposes or is intended to support (a) education, or (b) research; and (ii) is not intended for or directed toward user’s (a) commercial advantage or financial gain, (b) monetary compensation, or (c) more than a de minimis marketing or promotional benefit.
Noncommercial Use means USE by LICENSEE of the SOFTWARE and/or DOCUMENTATION only for academic teaching purposes, or for nonprofit or not for profit research performed by LICENSEE, wherein the research (i) does not now or in the future benefit or involve, or is not funded by, a commercial entity; and/or (ii) is not now, or in the future, subject to consulting or licensing obligations or other grant of rights to any commercial entity ; and/or (iii) will not generate any intellectual property rights for any commercial entity, and (iv) the results of which will be released in the public domain by publication.
Noncommercial Use means the use of CELLS as research tools, including but not limited to use in the discovery and development of drugs and other products for the treatment or diagnosis of disease; provided, however, that the use of CELLS directly in the treatment or diagnosis of disease in humans shall be deemed a COMMERCIAL USE.
