Nuisance Dog definition

Nuisance Dog means any dog which, while off the dog owner's premises, in a dangerous, threatening, or terrorizing manner approaches a person with an apparent attitude of attack, or any dog while off the dog owner's premises which in a dangerous, threatening or terrorizing manner, pursues or harasses another animal without causing injury.
Nuisance Dog means a dog that "without provocation" and while off the premises of its owner, keeper, or harborer has chased or approached a person in either a "menacing fashion" or an apparent attitude of attack or has attempted to bite or otherwise endanger any person. It does not include a "police dog" that while being used to assist one or more law enforcement officers in the performance of official duties has chased or approached a person in either a menacing fashion or an apparent attitude of attack or has attempted to bite or otherwise endanger any person1 (see below for definitions of the terms in quotation marks).

Examples of Nuisance Dog in a sentence

  • Nuisance dog, $100.00 mandatory minimum fine, $200.00 for a second offense, and an increase of $100.00 for each subsequent offense with a maximum fine of $1,000.00.

  • No Owner shall willingly and knowingly permit a dog to be a Nuisance dog as defined herein.

  • Nuisance dog – a dog that (i) by excessive barking or other disturbance, is a source of annoyance to a sick person residing in the vicinity; or (ii) by excessive barking, causing damage or other interference, a reasonable person would find such behavior disruptive to one’s quiet and peaceful enjoyment; or (iii) has threatened or attacked livestock, a domestic animal or a person, but such threat or attack was not a grossly disproportionate reaction under all the circumstances.

  • Willingly and knowingly shall be defined as the Owner of the dog having received one prior warning, verbally or in writing, given by any Enforcement Personnel described in Section 6, notifying the Owner that the dog is considered a Nuisance dog.

More Definitions of Nuisance Dog

Nuisance Dog means any dog that has been the subject of three or more Violation Tickets within any three year period for violations of any combination of section 4.4 and section 4.6 under this Bylaw

Nuisance Dogs are deemed to be dogs that are not under the control of their Owner.
