Nuisance dog, $100.00 mandatory minimum fine, $200.00 for a second offense, and an increase of $100.00 for each subsequent offense with a maximum fine of $1,000.00.
No Owner shall willingly and knowingly permit a dog to be a Nuisance dog as defined herein.
Nuisance dog – a dog that (i) by excessive barking or other disturbance, is a source of annoyance to a sick person residing in the vicinity; or (ii) by excessive barking, causing damage or other interference, a reasonable person would find such behavior disruptive to one’s quiet and peaceful enjoyment; or (iii) has threatened or attacked livestock, a domestic animal or a person, but such threat or attack was not a grossly disproportionate reaction under all the circumstances.
Willingly and knowingly shall be defined as the Owner of the dog having received one prior warning, verbally or in writing, given by any Enforcement Personnel described in Section 6, notifying the Owner that the dog is considered a Nuisance dog.
