O & M Plan definition

O & M Plan means the Operations and Maintenance Program, if any, established with respect to the monitoring, removal, remediation, encapsulation or other treatment or handling of asbestos containing materials present at any Related Premises, prepared by ATC Associates, Inc. and dated on or about March 2, 2004, as same may be amended, renewed, supplemented or otherwise modified from time to time.
O & M Plan means the portion of the O'Melveny & Xxxxx Partnership Agreement entitled Retirement, Death and Disability Payments (currently Section 10 of such partnership agreement).

We are permitted to make this payment under the terms of the 12b-1 Plans adopted by certain of the Funds, as such Plans may be in effect from time to time. The 12b-1 Plans in effect on the date of this Agreement are described in the Funds' Prospectuses. Each Fund reserves the right to terminate or suspend its 12b-1 Plan at any time as specified in the Plan and we reserve the right, at any time, without notice, to modify, suspend or terminate payments hereunder in connection with such 12b-1 Plan. You will furnish the Fund and us with such information as may be reasonably requested by the Fund or its directors or trustees or by us with respect to such fees paid to you pursuant to this Agreement.

  • Company 401(k) Plan shall have the meaning set forth in Section 6.09(e).

  • Erosion and sediment control plan or "plan" means a document containing material for the conservation of soil and water resources of a unit or group of units of land. It may include appropriate maps, an appropriate soil and water plan inventory and management information with needed interpretations, and a record of decisions contributing to conservation treatment. The plan shall contain all major conservation decisions to ensure that the entire unit or units of land will be so treated to achieve the conservation objectives.

  • Parent Plan means an Employee Benefit Plan sponsored, maintained, or contributed to by Parent or its Affiliates or with respect to which Parent or its Affiliates have any liability.
