Operable Unit 4 definition

Operable Unit 4 or “OU 4” shall mean the De Pere to Green Bay reach of the Lower Fox River, as delineated by the Record of Decision signed by WDNR and EPA in June 2003 (Dkt. 404-2). More specifically, OU 4 is the portion of the Lower Fox River (and the underlying River sediment) from the De Pere Dam downstream to the River’s mouth at Green Bay. In addition:
Operable Unit 4 means the following portion of the Diamond Alkali Site: the area defined by the EPA as the Lower Passaic River Study Area encompassing the 17.4 mile tidal stretch of the river from Dundee Dam to Newark Bay, exclusive of Operable Xxxx 0 for Newark Bay; but not including Operable Unit 1 or the former manufacturing plant located at 80 and 000 Xxxxxx Xxxxxx, Xxxxxx, Xxx Xxxxxx.
Operable Unit 4 or “OU4” shall mean the fourth reach of the Lower Fox River, as delineated by the Record of Decision signed by WDNR and EPA in June 2003. More specifically, OU4 is the portion of the Lower Fox River (and the underlying River sediment) starting at the De Pere Dam and ending at Green Bay. As so defined, OU4 is depicted in Figure 7-36 of the December 2002 Final Feasibility Study, a copy of which is attached hereto as Attachment B-3.

Operable Unit 4 or "OU4" means noncontiguous, asymmetrical parts of the Site(both urban and rural), that are not presently used for residential purposes or which are sparsely used for residential purposes, where mine and mill tailings have been deposited, stored, disposed of, placed, or otherwise come to be located as a result of mining, milling or related operations (e.g., in a rural Site area– an area with one or two residences per square mile, containing former flotation pond areas, chat bases or chat piles and associated transition zones; or, in an urban Site
Operable Unit 4 means the area defined by the EPA as the Lower Passaic River Study Area encompassing the 17.4 mile tidal stretch of the river from Dundee Dam to Newark Bay, exclusive of Operable Unit 3 for Newark Bay; but not including Operable Unit 1 or the former manufacturing plant located at 80 and 120 Lister Avenue, Newark, New Jersey.

Specifically excluded from OU4 are mine and mill tailings located on roadways or alleyways, or that has been physically transported to a location that is not contiguous with its original location by someone other than a mine or mill operator in connection with mining, milling or related operations. Excepted from the exclusion in the preceding sentence, and included in OU4, are unpaved roadways or alleyways that are built on or contiguous to chat piles, chat bases, or flotation ponds OU4 does not include mine shafts, or underground mine workings. OU4 is generally described on the attached Map (Attachment 3) entitled "Map of Operable Unit 4, Tar Creek Superfund Site;" however, the size and shape of OU4 may change somewhat as new information is gathered as the RI/FS proceeds (EPA, 2003).
Operable Unit 4 means the area of contamination downgradient of the AVX Property for which an investigation was commenced by EPA in 2014.
Operable Unit 4 or “OU4” shall mean the EPA-approved remedial action that addresses the Site-wide ecological risks and the impacts of the contamination on the regional surface water and groundwater.
Operable Unit 4 or “OU 4” shall mean that portion of the Site that comprises all upland areas of the watershed to the Site boundary including waste and by-product piles and the Copperhill plant site and the Cantrell Flats plant site, which are separated by Davis Mill Creek.
Operable Unit 4 or “OU4” means the Site areas described as OU4 in the Record of Decision.
