Other Subject Products definition

Other Subject Products means any motor vehicle Product: (i) a principal effect of which is to bypass, defeat, or render inoperative a motor vehicle emission control device or Emissions-Related Element of Design; (ii) that enables an Emissions-Related Element of Design to be removed, disabled or bypassed, (iii) that interferes with the function of, or allows the removal of, one or more Emissions-Related Elements of Design; (iv) that modifies one or more Emissions- Related Elements of Design; or (v) that is materially similar to any of the Identified Subject Products.

Other Subject Products means any motor vehicle or motor vehicle engine part or component, including, but not limited to, tunes, software, or programming (and devices on which such tunes, software or other programming are loaded), a principal effect of which is to bypass, defeat, or render inoperative a motor vehicle emission control device or Emission- related Element of Design. Other Subject Products include, but are not limited to, (a) delete tunes, which enable a motor vehicle or motor vehicle engine’s emission control device or Emissions-Related Element of Design to be removed, disabled or bypassed; and (b) calibration tunes, which affect one or more Emissions-related Elements of Design. Other Subject Products do not include products that are covered by a CARB Executive Order or a pending Complete Application for a CARB Executive Order pursuant to Paragraph 16;

  • Tobacco products means cigars, cigarettes, cheroots, stogies, periques, granulated, plug cut, crimp cut, ready rubbed, and other smoking tobacco, snuff, snuff flour, moist snuff, cavendish, ping and twist tobacco, fine-cut and other chewing tobaccos, shorts, refuse scraps, clippings, cuttings and sweepings of tobacco, and other kinds and forms of tobacco, prepared in such manner as to be suitable for chewing or smoking in a pipe or otherwise, or both for chewing and smoking.

  • Other Products means products other than Printable Media Products that were or are reasonably similar in form or function to the products developed (or under development), manufactured, marketed, distributed or sold by the Business as of the date of this Agreement or resulting from the normal progression of the business or technology related to such products. Other Products include: (i) organization, presentation and filing products (including indexes, dividers, binders, file folders, report covers and sheet protectors); (ii) writing instruments (including markers, highlighters and stick pens); (iii) stamp products; (iv) organization and identification products for professionals and individuals in the home, office and on-the-go; (v) organization, identification and other products related to education and learning; (vi) all other products intended for office or consumer use (including consumer glue products such as glue sticks or bottled glue for arts and crafts).
