PAGA Aggrieved Employees definition

PAGA Aggrieved Employees shall be defined as: All current and former non-exempt employees who worked for Defendant Prime Converting Corporation in California from February 26, 2020 until May 31, 2022 (the “PAGA Period”).
PAGA Aggrieved Employees means all non-exempt, hourly employees employed
PAGA Aggrieved Employees means all current and former employees of 18 Autodesk employed in California during the PAGA Period who were subject to stay-at-home 19 orders and/or whose offices were closed due to COVID-19 for at least one pay period during the 20 PAGA period and did not receive a fully paid wireless internet device for work purposes.

  • One hundred thousand dollars ($100,000) of the total amount allocated to the Spruill Action is allocated to the settlement of Plaintiff Spruill’s PAGA claim, 75% of which will be paid to the Labor & Workforce Development Agency and 25% of which will be paid to PAGA Aggrieved Employees on a pro-rata basis.

  • PAGA Aggrieved Employees who opt out of the Settlement will receive a single check for their pro-rata share of the $25,000 allocated to PAGA Aggrieved Employees.

  • Specifically, each Settlement Class member’s payment from the PAGA Amount will be calculated by multiplying the PAGA Amount by a fraction, the numerator of which is the PAGA Aggrieved Employee’s number of workweeks worked during the PAGA Period, and the denominator of which is the total workweeks worked by all PAGA Aggrieved Employees during the PAGA Period.

  • The 25 portion of the PAGA Payment to be distributed to the PAGA Aggrieved Employees shall be distributed 26 to the PAGA Aggrieved Employees based on the months the individual PAGA Aggrieved Employees 27 worked for Defendant during the PAGA Period.

  • The remaining 25% of the PAGA Payment ($11,875) shall be 28 distributed to all PAGA Aggrieved Employees, with each receiving a pro rata share based on the DocuSign Envelope ID: BDF97D9C-6021-4C02-9621-5C614D6450E7 DocuSign Envelope ID: FF20DA7D-306F-471C-A215-C3D4B805333E 1 number of pay periods worked during the PAGA Period.

  • PAGA Aggrieved Employees may not opt out of the settlement and will receive the Net PAGA Amount regardless of whether or not they are Non-Participating Class Members.


More Definitions of PAGA Aggrieved Employees

PAGA Aggrieved Employees means all current and former aggrieved employees who were 1)employed as security guards; and 2)classified as non- exempt employees by Defendant in California as at any time during the PAGA Period. The PAGA Aggrieved Employees are a subset of the Class Members.

  • Aggrieved Employee means a person employed by Defendant in California and classified as a nonexempt employee who worked for Defendant during the PAGA Period.

  • Part-Time Employees means employees employed on a permanent basis, but obligated to work less than a full (i.e., forty-hour) work week.

  • Tipped employee means any employee engaged in an occupation in which s/he customarily and regularly receives more than $30 per month in tips. Tips include amounts designated as a tip by credit card customers on their charge slips. Nothing in this rule prevents an employer from requiring employees to share or allocate such tips or gratuities on a pre-established basis among other employees who customarily and regularly receive tips. Employer-required sharing of tips with employees who do not customarily and regularly receive tips, such as management or food preparers, or deduction of credit card processing fees from tipped employees, shall nullify allowable tip credits towards the minimum wage.

  • Former Employees means Former Parent Group Employees and Former SpinCo Group Employees.

  • Other Employees means, all the employees other than the Directors, KMPs and the Senior Management Personnel.

  • Business Employees has the meaning set forth in Section 4.10(a).

  • Permanent Employees means all employees who are not casual employees, or employees working in a long-term supply assignment, as defined below.

  • Newly hired employee or “New Hire” means any employee, whether permanent, full-time, or part-time, hired by the Office and who is still employed as of the date of new employee orientation. It also includes all employees who are or have been previously employed by the Office and whose current position has placed them in the bargaining unit represented by CSEA. For those latter employees, for purposes of this article only, the “date of hire” is the date upon which the employees’ employment status changed as such that the employee was placed in the CSEA unit.

  • Relevant Employees means the employees who may be affected by a change referred to in subclause (1).
