A PAGA Employee shall receive a portion of the PAGA Amount proportionate to the number of Workweeks that he or she worked during the period the PAGA Period and which will be calculated by multiplying the PAGA Amount by a fraction, the numerator of which is the PAGA Employee’s number of Workweeks worked during the PAGA Period, and the denominator of which is the total number of Workweeks worked by all PAGA Employees during the PAGA Period.

If you qualify as a PAGA Employee, you will be bound to the release of Released PAGA Claims and will be issued your Individual PAGA Payment, irrespective of whether you exclude yourself from the Class Settlement.
Each Participating Class Member, PAGA Employee, and Plaintiff shall be responsible for remitting to state and/or federal taxing authorities any applicable taxes which may be owed on the portion of any Individual Settlement Payment and PAGA Payment Share received pursuant to this Settlement, except as provided by this Settlement.
The Claims Administrator will issue you a check for your Class Settlement Payment and PAGA Employee Payment, as applicable.
