Party In Breach definition

Party In Breach is defined in Article 15.1;
Party In Breach means a Party who has caused a Breach of any of the terms contained in this Agreement.

  • Termination of this Agreement shall not affect the right of the Party Not In Breach to assert against the Party In Breach damages as well as any other claims that may be incurred by the Party Not In Breach due to the breach of contract or delay in the performance of the obligation and the resulting premature termination of the Agreement.
