Non-Breaching Party definition

Non-Breaching Party has the meaning set forth in Section 9.2.1.
Non-Breaching Party shall have the meaning set forth in Section 21.1 of this Agreement.

Examples of Non-Breaching Party in a sentence

  • If (i) the breach is not cured within the thirty (30) day period after receipt of the written notice and (ii) the parties have not otherwise resolved the breach during the thirty (30) day period, the Non-Breaching Party may terminate this Agreement by delivering a second notice to the Breaching Party specifying the date on which the termination is to be effective.

  • Subject to compliance with Section 22.1 of this Agreement, if applicable, the Non-Breaching Party shall also have the right to pursue any and all rights it may have against the Breaching Party under applicable law, subject to other applicable terms and conditions of this Agreement (including, without limitation, any applicable limitations on liability contained herein).
