Permitted Nominee definition

Permitted Nominee means a person or entity permitted by the Board, pursuant to clause 7.2 of the Rules, to accept an offer of Loan Options made to an Eligible Person in place of the Eligible Person.

Permitted Nominee means any nominee of a Prepetition Lender that such Prepetition Lender has confirmed in writing to the Debtors and the First Lien Agent (or the Second Lien Agent, as the case may be) that it is such Prepetition Lender’s nominee for the purposes of distribution of some or all of such Prepetition Lender’s Plan Distribution Property, provided that such nominee shall be an affiliate of such Prepetition Lender.
