Phase 2 Completion Date definition

Phase 2 Completion Date means (subject to Clause 29 (Delay Events)) the date described as such in Schedule Part [ ] or such other date as the parties may agree;]

Phase 2 Completion Date means that date described in Section 5.04 and Exhibit G

Phase 2 Completion Date means the date which is the date that is 18 months from the Phase 1 Completion Date provided that such date shall be extended by a period equal to any period of time lost as a result of Force Majeure or as otherwise provided for in this Agreement and may be extended by the mutual written agreement of the Parties.

• Prior to the Phase 2 Completion Date, moneys in the Bond Proceeds (Project Costs) Subaccount and the HPTE Capital Subaccount, were disbursed (subject to Section 4.03(e) of the Original Security Agreement) by the Security Trustee to the Concessionaire to pay, or reimburse for a prior payment of construction related Project Costs contemplated in Section 4.03(d)(ii) of the Original Security Agreement (for certainty not including any Debt Service) in the manner and at the time contemplated in such section.

• Additionally, Lessee shall spend a minimum Capital Expenditure amount of Five Million and No/100 Dollars ($5,000,000.00) ("Phase 2 Minimum Capital Expenditure") to complete all the Improvements required in Section 6.2(b) no later than the Phase 2 Completion Date.

• Lessee shall provide, upon request, such invoices and other back‐up documentation as may be required by the Aviation Department or the CPA to verify that each phase of Minimum Capital Expenditures has been individually met by Lessee by the respective Phase 1 Completion Date and Phase 2 Completion Date.
