Plan Investor definition

Plan Investor. As defined in Section 5.03(n) of this Agreement.
Plan Investor. Any Plan, any Person acting on behalf of a Plan or any Person using the assets of a Plan.
Plan Investor. With respect to a transfer of a Certificate, an employee benefit or other plan subject to the prohibited transaction provisions of ERISA or Section 4975 of the Code, or any person (including an investment manager, a named fiduciary or a trustee of any such plan) acting, directly or indirectly, on behalf of or purchasing such Certificate with “plan assets” of any such plan. Prepaid Monthly Payment: Any Monthly Payment received prior to its scheduled Due Date, which is intended to be applied to a Mortgage Loan on its scheduled Due Date and held in the related Custodial Account for P&I until the Withdrawal Date following its scheduled Due Date.

Examples of Plan Investor in a sentence

  • A Person (other than a Benefit Plan Investor) who has discretionary authority or control with respect to the assets of the Issuer or any Person who provides investment advice for a fee (direct or indirect) with respect to such assets or an affiliate of any such Person.

  • For the avoidance of doubt, the term Benefit Plan Investor includes all employee benefit plans subject to Part 4, Subtitle B, Title I of ERISA, any plan to which Section 4975 of the Code applies and any entity, including any insurance company general account, whose underlying assets constitute “plan assets”, as defined under the Plan Asset Regulation, by reason of a Benefit Plan Investor’s investment in such entity.

  • The Trust Certificates may not be acquired or held by a Benefit Plan Investor, a Plan that is subject to Similar Law or a person who is not a United States Person within the meaning of Section 7701(a)(30) of the Code.

Plan Investor means (i) a "benefit plan investor" that is described in or subject to the Department of Labor regulations set forth in 29 C.F.R. § 2510.3-101, as modified by ERISA Section 3(42) (the "Plan Asset Regulations"), (ii) a plan or arrangement that is subject to Code Section 4975, (iii) a "governmental plan" as defined in Section 3(32) of ERISA, (iv) any plan or arrangement that is subject to any federal, state, local law or non-US law that is substantially similar to Section 406 of ERISA or Section 4975 of the Code.
Plan Investor. Any Plan or any governmental plan as described in Section 3(32) of ERISA subject to Similar Law, or any Person acting on behalf of any such Plan or governmental plan or using the assets of such Plan or governmental plan.

Plan Investor means any entity that is, or that is using the assets of, (A)(i) an "employee benefit plan" (as defined in Section 3(3) of the United States Employee Retirement Income Security Act of 1974, as amended ("ERISA")) that is subject to the fiduciary responsibility requirements of Title I of ERISA, (ii) a "plan" to which Section 4975 of the United States Internal Revenue Code of 1986, as amended (the "Code"), applies, or (iii) an entity whose underlying assets include "plan assets" (as defined pursuant to the "Plan Assets Regulation" issued by the United States Department of Labor at 29 C.F.R. Section 2510.3-101 as modified by Section 3(42) of ERISA) or otherwise under ERISA by reason of any such employee benefit plan or plan's investment in the entity (any such plan or entity described in (i), (ii) or (iii), a "Benefit Plan Investor") or (B) a non-U.S. plan, governmental plan, church plan or other plan that is subject to any federal, state, local, non-U.S. or other law that is similar to the provisions of Section 406 of ERISA or Section 4975 of the Code (a "Similar Law") unless its acquisition, holding and disposition of such security, or any interest therein, has not and will not result in a violation of such Similar Law.
