Planned Full Services Commencement Date definition

Planned Full Services Commencement Date means December 31, 2015 or such other date agreed or determined to be the Planned Full Services Commencement Date pursuant to this Agreement.

Examples of Planned Full Services Commencement Date in a sentence

  • Permitting or requiring the Concessionaire to continue and finish the Phase 2 Work or any part thereof after the Planned Full Services Commencement Date shall not act as a waiver of HPTE's right to receive Liquidated Damages or to receive sums in accordance with Section 20.2(a) hereunder or any rights or remedies otherwise available to HPTE.

  • The Concessionaire acknowledges and agrees that the Liquidated Damages have been set based on an evaluation by HPTE of damages, it will incur if there is a failure to achieve the Full Services Commencement Date by the Planned Full Services Commencement Date.

  • HPTE agrees that the payment of Liquidated Damages under Section 20.2(a) and the reduction of the right to receive Toll Revenues under Section 20.2(b) are the sole and exclusive remedies for, and shall constitute full and final satisfaction of, any and all damages that may be claimed by HPTE as a result of the Concessionaire not achieving Phase 2 Work Completion by the Planned Full Services Commencement Date.

  • The Concessionaire will promptly begin the Phase 2 Work so as to achieve Phase 2 Work Completion on or before the Planned Full Services Commencement Date and will commence the delivery of the Services and the Snow and Ice Control Services in relation to the I-25 Managed Lanes and the I-25 Shared Bridge Decks and shall start to receive Toll Revenues in relation to the I-25 Managed Lanes.

  • If the Concessionaire requests a time extension, then HPTE, in its sole discretion, may require the Concessionaire to provide two alternative Change Order requests, one of which shall provide for a time extension and any additional costs permitted hereunder, and the other of which shall show all acceleration costs associated with meeting the original Planned Full Services Commencement Date, as well as any additional costs permitted hereunder.

  • Costs of rearranging the Concessionaire’s work plan not associated with an extension of the Planned Full Services Commencement Date and/or the Full Services Commencement Longstop Date shall not be compensable hereunder.

  • The Concessionaire may request a Change Order to extend the Planned Full Services Commencement Date and/or the Full Services Commencement Longstop Date only for the delays in the Critical Path caused by the following matters: (vii) Any matter referred to in paragraph (a).

  • If an event or situation occurs which may result in a claim for a Change in Costs or the alteration of the Planned Full Services Commencement Date and/or of the Full Services Commencement Longstop Date, HPTE will evaluate the situation and determine whether it wishes to order any Changes so as to bring it within HPTE’s funding and time restraints.

  • The City Council may elect to withdraw a Rented Dwelling from the Project if, by the Planned Full Services Commencement Date (Refurbishment), the Contractor has been unable to satisfy the Availability Standards Rented (Full) in relation to that Rented Dwelling as a consequence of a Works or Services Denial Event and clause 28.6 (Change to Numbers of Dwellings by Tenure) shall apply to that Dwelling as if that Dwelling had been the subject of a CNDT.

  • Services Commencement Date means the date delivery of the Services shall commence as specified in the Key Provisions. If no date is specified in the Key Provisions this date shall be the Commencement Date;
