Prepetition Notes Documents means the Prepetition Secured Notes, the Prepetition Note Purchase Agreement and all certificates, instruments, agreements, guarantees and other documents made or delivered in connection therewith.

Prepetition Notes Documents has the meaning given such term in the Interim DIP Order.

• For the avoidance of doubt, this Agreement does not amend, restate, modify or supplement the Prepetition Notes Documents.

• None of the DIP Agent, the DIP Lenders, or the Prepetition DIP Notes Parties shall be required to file proofs of claim in the Chapter 11 Cases or any Successor Cases for any claims allowed herein, including claims for the DIP Obligations under the DIP Loan Documents, the DIP Superpriority Claims, the DIP Liens, or the Prepetition Notes Obligations under the Prepetition Notes Documents.

• Notwithstanding any provision in the DIP Loan Documents, the Prepetition Term Loan Documents, the Prepetition Notes Documents or the Bridge Loan Documents, this Court shall retain jurisdiction over all matters pertaining to the implementation, interpretation and enforcement of this Interim Order, the DIP Facility or the DIP Loan Documents.

Prepetition Notes Documents means the Prepetition Indenture, the Prepetition Notes, the Prepetition Security Agreement, and any other document, agreement, or instrument entered into in connection with the foregoing.

Prepetition Notes Documents means the “Notes Documents” as defined in the Prepetition Indenture.

Prepetition Notes Documents means the documents governing the Prepetition Notes.

Prepetition Notes Documents means, collectively, (a) the 4% Notes Documents, (b) the 6% Notes Documents, (c) the 6% Unsecured Notes Documents and (d) the 8.5% Notes Documents.
