For certainty, for the purposes of this Agreement, the term “Applicant” as referenced in the Rate Handbook shall be construed as “Customer”.
Parts III and IV of the Rate Handbook and all applicable ‘Riders’ in the Rate Handbook are incorporated into this Agreement and form part hereof.
Parts III and IV of the Rate Handbook and such ‘Riders’ shall be construed using the definitions in this Agreement and the terms used therein and not otherwise defined in this Agreement shall be construed using the definitions in Part I of the Rate Handbook.
If there is any conflict between the provisions of this Agreement and the provisions of the Rate Handbook, then the provisions of the Rate Handbook then in effect shall prevail.
Gas delivered to the Customer hereunder shall be converted from energy to volume at the rate published in the Rate Handbook.

This Agreement is subject to terms and conditions in the following documents: C Ontario Energy Board Act, 1998; • Electricity Act,1998; C Distributor’s licence; C Retailer’s licence; C Electric Distribution Rate Handbook; C Affiliate Relationships Code for Electricity Distributors and Transmitters; C Retail Settlement Code; C Distribution System Code; and C Electricity Retailer Code of Conduct.
During the term of a Pool, in order to attempt to balance the actual aggregate volumes of Gas Delivered and Gas Taken in respect of a Pool, the Customers associated with the relevant Pool, or the Agent on their behalf, may take such steps and actions as are set out and provided for in the Rate Handbook and the Transaction Rules.
Any amount to be remitted by the Customer under this Agreement and which is not remitted on or before the relevant due date shall bear interest at the rate set out in the Rate Handbook (currently Part III, Section F), compounded monthly, until the amount, and all interest thereon, has been paid in full.
