Releasing Defendants. Claims” means all claims and causes of action of every nature and description, whether known or unknown (including Unknown Claims as defined in ¶1.38 herein), whether arising under federal, state, or common law, that arise out of or relate in any way to the institution, prosecution or settlement of the Action or the Released Claims against the Released Defendants. Notwithstanding the foregoing, “Releasing Defendants’ Claims” does not include claims relating to the enforcement of the Settlement.
Releasing Defendants means the University of Southern California, the Board of Trustees of the University of Southern California, and George M. Tyndall, M.D.

  • If the Settlement, other than terms pertaining to the attorneys’ fees and costs and/or service awards to Class Representatives, is materially modified by any court, Releasing Defendants may, in their sole discretion to be exercised within 14 days after such a material modification, declare the Settlement void.
