Reserved Material definition

Reserved Material means trademarks, trade dress, and creative expressions that are not essential to, or can be varied without altering, the ideas or methods of operation of a game system, including works of visual art, music and sound design, and clearly expressed and sufficiently delineated characters, character organizations, dialogue, settings, locations, worlds, plots, or storylines, including proper nouns and the adjectives, names, and titles derived from proper nouns. The term Reserved Material shall in no event include elements that have been previously expressly designated as Licensed Material by that material’s Licensor, that are Adapted Licensed Material, that constitute Third Party Reserved Material, or that are in the public domain.
Reserved Material means the Initial Reserved Material and, if applicable, the Additional Reserved Material and the Extra Reserved Material.

Examples of Reserved Material in a sentence

  • If sidewalk is to be demolished, parking meter posts shall be considered Reserved Material; otherwise, posts shall not be disturbed.

  • All material except personal property, that specifically belonging to others, and that specifically reserved by the City as described under the heading Reserved Material, shall become the property of the contractor.

  • In the event of a conflict between Your designation of Reserved Material and the definition of Licensed Material, the definition shall control.

  • For avoidance of doubt, such designation neither limits Your rights in Your Reserved Material nor limits any downstream licensee’s Use of the Adapted Licensed Material.

  • A statement based on reasonable, good-faith efforts that identifies the elements of Your Reserved Material, if any, contained in the Derivative Work in which You Use the Licensed Material.

  • This constitutes a limitation on Licensor remedies with respect to the license grant in the Licensed Material hereunder; however, this ORC License neither limits Licensor’s remedies in any way with respect to Licensor’s Reserved Material, nor does it limit Licensor’s right to offer the Licensed Material or Reserved Material under separate terms or conditions.

  • Expressly Designated Licensed Material The following elements are owned by the Licensor and would otherwise constitute Reserved Material and are hereby designated as Licensed Material: The Bardic Order of the Singing Skull and associated characters, locations, and titles.

  • Reserved Material Reserved Material elements in this product include, but may not be limited to: The Skeleton Krew, The Horrible Nation of Funeralia, The Order of Ossuaries & Edgelords, and all elements designated as Reserved Material under the ORC License.

  • A statement that identifies any elements of Your content that would otherwise constitute Reserved Material contained in Your Derivative Work that You agree to offer to prospective licensees under the ORC License as Licensed Material pursuant to Section I.e.(1) above.

  • A reservation must comprise all or part of a single manufacturing lot (approximately two thousand (2,000) units for media Reserved Material).

Related to Reserved Material

  • Adapted Material means material subject to Copyright and Similar Rights that is derived from or based upon the Licensed Material and in which the Licensed Material is translated, altered, arranged, transformed, or otherwise modified in a manner requiring permission under the Copyright and Similar Rights held by the Licensor. For purposes of this Public License, where the Licensed Material is a musical work, performance, or sound recording, Adapted Material is always produced where the Licensed Material is synched in timed relation with a moving image.

  • Produced Material means records, software and other material, whether complete or not, that, as a result of this Agreement, are produced or provided by the Contractor or a Subcontractor and includes the Incorporated Material;

  • Licensed Material means the artistic or literary work, database, or other material to which the Licensor applied this Public License.

  • Received Material means records, software and other material, whether complete or not, that, as a result of this Agreement, are received by the Contractor or a Subcontractor from the Province or any other person;

  • Harvested Material means the grain or fodder from crops of the Licensed Varieties grown from Seed or Retained Seed.

  • Recycled material means any material that would otherwise be a useless, unwanted or discarded material except for the fact that the material still has useful physical or chemical properties after serving a specific purpose and can, therefore, be reused or recycled.

  • Dredged material means any material removed from the bed of a navigable waterway by dredging. The bed of a navigable waterway extends landward to the OHWM.

  • Beam axis means a line from the source through the centers of the x-ray fields.

  • Cloud Materials means any materials provided or developed by SAP (independently or with Provider’s cooperation) in the course of performance under the Agreement, including in the delivery of any support or Consulting Services to Provider or its Customers. Cloud Materials do not include any Customer Data, Provider Confidential Information, or the SAP Cloud Service.

  • Advanced materials means materials with engineered

  • Licensed Materials means any materials that Executive utilizes for the benefit of the Company (or any Subsidiary thereof), or delivers to the Company or the Company’s Customers, which (a) do not constitute Work Product, (b) are created by Executive or of which Executive is otherwise in lawful possession and (c) Executive may lawfully utilize for the benefit of, or distribute to, the Company or the Company’s Customers.

  • Supplier Software means software which is proprietary to the Supplier or its Affiliates which is used or supplied by the Supplier in the provision of the Services; Supplier Staff means all persons employed or engaged by the Supplier together with the Supplier's servants, agents, suppliers, consultants and Sub-Contractors (and all persons employed by any Sub-Contractor together with the Sub-Contractor’s servants, consultants, agents, suppliers and Sub-Contractors) used in the performance of its obligations under this Contract; Time and Materials means the pricing mechanism for the Services as may be agreed by the Parties and set out at paragraph Error: Reference source not found in the SOW; TUPE means the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) as amended or replaced or any other regulations or UK legislation implementing the Acquired Rights Directive; Velocity means the Metric which measures the total number of Story Points for Stories that have been accepted in a Sprint, indicating the rate of progress towards Acceptance of all Stories from the Product Backlog;

  • Restricted materials means pesticides established as restricted materials under Title 3, California Code of Regulations, section 6400.

  • Developed Materials means Materials created, made, or developed by Contractor or Subcontractors, either solely or jointly with the Judicial Branch Entities or JBE Contractors, in the course of providing the Work under this Agreement, and all Intellectual Property Rights therein and thereto, including, without limitation, (i) all work-in-process, data or information, (ii) all modifications, enhancements and derivative works made to Contractor Materials, and (iii) all Deliverables; provided, however, that Developed Materials do not include Contractor Materials.

  • Input Material means all documents, information, representations, statements and materials provided by Customer or a third party on behalf of Customer, relating to the Services, including computer programs, data, logos, reports and specifications and inventories.

  • Supplier System means the information and communications technology system used by the Supplier in performing the Services including the Software, the Equipment and related cabling (but excluding the Customer System);

  • Standard Materials means all Materials not specified as Custom Materials.

  • Fissile material means the radionuclides uranium-233, uranium-235, plutonium-239, and plutonium-241, or any combination of these radionuclides. "Fissile material" means the fissile nuclides themselves, not material containing fissile nuclides. Unirradiated natural uranium and depleted uranium and natural uranium or depleted uranium, that has been irradiated in thermal reactors only, are not included in this definition. Certain exclusions from fissile material controls are provided in 10 CFR 71.15.

  • Functional Specifications means the descriptions of features and functions of the Application as expressly set forth in Quote.

  • Genetic material means any material of plant, animal, microbial or other origin containing functional units of heredity.

  • Contractor Software means software which is proprietary to the Contractor, including software which is or will be used by the Contractor for the purposes of providing the Services.

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Manufacturing Materials means parts, tools, dies, jigs, fixtures, plans, drawings, and information produced or acquired, or rights acquired, specifically to fulfill obligations set forth herein.

  • MSAA Indicator Technical Specifications document means, as the context requires, either or both of the document entitled “Multi-Sector Service Accountability Agreement (MSAA) 2019-20 Indicator Technical Specifications November 5, 2018 Version 1.3” and the document entitled “Multi-Sector Service Accountability Agreement (MSAA) 2019-20 Target and Corridor-Setting Guidelines” as they may be amended or replaced from time to time;

  • Accelerator-produced material means any material made radioactive by a particle accelerator.

  • Standard Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Standard Software.
