Seller Trade Dress definition

Seller Trade Dress. (a) the trademarks, tradenames, brands, corporate names or similar items used by Seller or any of Seller’s Affiliates and (b) the layout, designs, and coloring used on the packaging of the Product to the extent used on other product packaging of Seller or any of Seller’s Affiliates.
Seller Trade Dress means (i) the trademarks, trade names, brands, corporate names or similar items owned and/or used by Seller or any of Seller's Affiliates, other than the Assigned Trademarks, and (ii) the layout, designs, and coloring used on the packaging of the Product to the extent used on other product packaging of Seller or any of Seller's Affiliates.
Seller Trade Dress means the stripes, bands or other designs, coloring and other trade dress used on or in connection with the packaging of Doral sample packs to the extent used on other product packaging of Seller or its Affiliates.

  • Buyer acknowledges that the Seller Trade Dress License is being granted solely for transitional purposes and that Buyer shall use all commercially reasonable best efforts to cease its use of the Seller Trade Dress as quickly as is reasonably possible after the Closing Date.

More Definitions of Seller Trade Dress

Seller Trade Dress means (i) the printed labels, labeling and packaging materials, including printed carton, container label and package inserts, used by Seller and bearing Seller's name and, as necessary NDC number or equivalent for the Product, and (ii) Seller's tablet imprint and engraving specification, as set forth in the Registrations and sold by Seller or its Affiliate under the name Tasmar(R) (tolcapone) in the Territory.
Seller Trade Dress means the current trade dress (including the overall look and feel of the Aventis package design, the block color design down the left side of all Aventis packaging, the color coding of all Aventis packaging and the Seller Trademark) used with the Product and the packaging, labeling and package inserts associated with the sale of the Product and the lettering of the Product name.
Seller Trade Dress means the current trade dress, other than the Product Trademarks, used exclusively with the Product and the packaging associated with the sale of the Product.
Seller Trade Dress means (i) the stripes, bands and coloring used on the packaging or ampule of any Product, and (ii) the tablet, capsule or ampule shape and coloring of any Product, in each case to the extent used on other Seller product packaging or for the tablets, capsules or ampules of other Seller products.

  • Trade Dress means a logo, insignia, or emblem attached to or visible from the exterior of a TNC

  • Product Trademarks means the Trademark(s) to be used by Adapt or its Affiliates or its or their respective Sublicensees for the Commercialization of Products and any registrations thereof or any pending applications relating thereto (excluding, in any event, any trademarks, service marks, names or logos that include any corporate name or logo of the Parties or their Affiliates).

  • counterfeit trademark goods means any goods, including packaging, bearing without authorization a trademark which is identical to the trademark validly registered in respect of such goods, or which cannot be distinguished in its essential aspects from such a trademark, and which thereby infringes the rights of the owner of the trademark in question under the law of the country of importation;

  • Transferred Technology has the meaning set forth in Section 2.3(a).

  • Licensed Trademark means those Trademarks set forth on Exhibit A attached hereto and such other Trademarks as may be designated by NovaDel in writing from time to time, and any registrations of the foregoing and pending applications relating thereto.

  • Product brand name means the name of the product exactly as it appears on the principal display panel of the product.

  • Brand Name Drug means a Prescription Drug that has been given a name by a manufacturer or distributor to distinguish it as produced or sold by a specific manufacturer or distributor and may be used and protected by a trademark.

  • Seller Products means all products and services that are being manufactured or performed by Seller at any time, other than Logic Business Products that are being manufactured or performed by Seller as of the Closing Date.

  • Product Know-How means Know-How to the extent related to the properties, manufacture or use of any products.

  • Customer Technology means Customer's proprietary technology, including Customer's Internet operations design, content, software tools, hardware designs, algorithms, software (in source and object forms), user interface designs, architecture, class libraries, objects and documentation (both printed and electronic), know-how, trade secrets and any related intellectual property rights throughout the world (whether owned by Customer or licensed to Customer from a third party) and also including any derivatives, improvements, enhancements or extensions of Customer Technology conceived, reduced to practice, or developed during the term of this Agreement by Customer.

  • Tyler Software means our proprietary software, including any integrations, custom modifications, and/or other related interfaces identified in the Investment Summary and licensed by us to you through this Agreement. • “we”, “us”, “our” and similar terms mean Xxxxx. • “you” and similar terms mean Client.

  • Licensed Content means those articles or other parts of a Licensed Title which form part of the content licensed in accordance with the Order (including all content published during the Subscription Period or other period specified in the Order to which access and use rights are granted under this Licence, and including all Previously Subscribed Material).

  • Licensed Know-How means any and all unpatented and/or non-patentable technical data, documents, materials, samples and other information and know‐how that is Controlled by LICENSOR or any of its Affiliates as of the Effective Date or thereafter during the Term that relates to, or is otherwise reasonably necessary or reasonably useful for, the use, Development, manufacture, or Commercialization of the Product.   • Trade Names means any words, name or symbol used by a Person to identify its business.

  • Seller Use means fuel used for gas compression, LPG plants and LNG plants, other gas needed by Seller's facilities to furnish the requirements of Buyers, together with unaccounted for gas. This gas shall be considered Included In Priority of Service Category 1. Other vital uses of Seller, such as flame stabilization requirements, will be met as long as such uses do not jeopardize service to its firm service Buyers.

  • Publicity Material means the promotional gifts, catalogues, pamphlets and all and any advertising and publicity material whatsoever which an Exhibitor wishes to display, distribute or use at the Exhibition.
