Settling Class Member definition

Settling Class Member means each and every Person who is a member of the Class who does not request to be excluded from the Class pursuant to a proper and timely written request for exclusion postmarked on or before the date to be set by the Court, and submitted according to the requirements set forth in the Preliminary Order and the Notice.
Settling Class Member means Settlement Class Members who have not opted out from this Settlement Agreement.

More Definitions of Settling Class Member

Settling Class Member means any person falling within the definition of the Settlement Class, except for persons who file timely and valid Requests for Exclusion from the Settlement Class and do not timely withdraw such Requests for Exclusion.
