Special Claims definition

Special Claims means (i) any breach by Ironclad of Section 2(e) (Customer Data), Section 2(f) (Information Security), or Section 5 (Confidentiality) resulting in unauthorized disclosure and misuse of Customer Data; or (ii) any amounts payable to third parties pursuant to Ironclad’s Data Indemnity obligations under Section 8(a)(ii). For any and all Special Claims, Ironclad’s aggregate liability shall be subject to an enhanced liability cap not to exceed ten times (10x) the amount paid by Customer to Ironclad during the twelve months prior to the event giving rise to liability (the “Enhanced Liability Cap”).
Special Claims has the meaning set forth in Section 10.3(b).

Examples of Special Claims in a sentence

  • CSP funds should be deposited into the project’s general operating account (account 1120 on the Balance Sheet) and recorded as Special Claims Revenue (account 5193).

  • Automated Special Claims cannot be used for: Outcomes claims outside of the 56 day claim period; Outcome claims for Participants transferred to a different Provider; Full Outcomes based a combination of Education and Employment activity; and Education Outcomes.

  • Note that where the JRRR is used to make a claim, claims must be submitted as a special claim through the Overrides and Special Claims application in the Department’s IT System for a Relationship Manager to process.

More Definitions of Special Claims

Special Claims shall have the meaning as set forth in Section 8.2(a).
Special Claims has the meaning provided therefor in Section 12.01 of this -------------- Agreement.
Special Claims means any unauthorised disclosure of Customer Data caused by a breach by First AML of its obligations under Section 4.2 (Security).
Special Claims has the meaning set forth in Section 12.6 below.
