Standards for Network Elements. 1.8.1 BellSouth shall comply with the requirements set forth in the technical references, as well as any performance or other requirements identified in this Agreement, to the extent that they are consistent with the greater of BellSouth’s actual performance or applicable industry standards. 1.8.2 If one or more of the requirements set forth in this Agreement are in conflict, the Parties shall mutually agree on which requirement shall apply. If the Parties cannot reach agreement, the dispute resolution process set forth in Section 12 of the General Terms and Conditions of this Agreement, incorporated herein by this reference, shall apply.

Standards for Network Elements. 32.10.1 Nothing in this Agreement shall be interpreted to require GTE to bundle or combine Network Elements upon AT&T’s request. Notwithstanding any other provision of this Agreement, GTE shall only be responsible for the functioning of each of the Network Elements that GTE provides to AT&T pursuant to this Agreement and under no event or circumstance shall GTE be responsible for the combined or end-to-end performance of any Network Element(s) that AT&T bundles or combines with any other Network Element(s). 32.10.2 This Agreement shall only require GTE to provide unbundled access to network elements to which GTE is required to provide access under Applicable Law (including Commission orders). For example, this Agreement shall not require GTE to provide access to network elements that do not exist as part of GTE’s network at the time of a requested order. GTE shall ensure that the quality of the Network Elements provided to AT&T shall be equal to network elements as such network elements would be provided by GTE to itself, its subsidiaries, its Affiliates or any other party to whom GTE provides Network Elements. Equal in quality includes, but is not limited to, parity in the design, provisioning, maintenance, and repair of Network Elements provided to AT&T. GTE shall not be required to provide AT&T with superior quality access to Network Elements. 32.10.3 [Intentionally Deleted] 32.10.3.1 If AT&T contends that GTE has failed to meet the requirements of this Section 32, AT&T will provide GTE documentation of such purported failure. Within a reasonable time period after receiving such documentation, GTE shall provide to AT&T engineering, design, performance and other network data that the parties mutually agree in accordance with Section 23.19 of this Agreement is necessary and sufficient for AT&T to determine that the requirements of this Section 32 are being met. In the event that such data establishes that the requirements of this Section 32 are not being met, GTE shall, within ten (10) business days, cure any design, performance or other deficiency and provide new data that the parties mutually agree is sufficient for AT&T to determine that such deficiencies have been cured. To the extent that GTE is unable to meet the above time frame, GTE shall promptly notify AT&T prior to the expiration of such time frame and the Parties shall agree on a revised completion date. 32.10.3.2 The Parties agree to work cooperatively with each other to effectuate the terms ...
Standards for Network Elements. 3.1 Each Network Element shall be furnished at a service level equal to or better than the requirements set forth in the technical references referenced in the following, as well as any performance or other requirements, identified herein. In the event Xxxx Communications Research, Inc. (“Bellcore”), or industry standard (e.g., American National Standards Institute (“ANSI”) technical reference or a more recent version of such reference sets forth a different requirement, MCIm may elect, where Technically Feasible, that such standard shall apply. 3.2 If one or more of the requirements set forth in this Agreement with respect to BellSouth’s obligations to MCI are in conflict, MCIm shall elect which requirement shall apply. 3.3 Each Network Element provided by BellSouth to MCIm shall be at least equal in the quality of design, performance, features, functions, capabilities and other characteristics, including but not limited to levels and types of redundant equipment and facilities for power, diversity and security, that BellSouth provides to itself, BellSouth's own subscribers, to a BellSouth Affiliate or to any other entity. 3.3.1 BellSouth shall provide to MCIm, upon request, engineering, design, performance and other network data sufficient for MCIm to determine that the requirements of this Section 3 are being met. In the event that such data indicates that the requirements of this Section 3 are not being met, BellSouth shall, within ten (10) days, cure any design, performance or other deficiency, or, if the failure is not susceptible to cure within ten (10) days shall commence and continue its best efforts to correct such failure as soon as possible, and provide new data sufficient for MCIm to determine that such deficiencies have been cured. 3.3.2 BellSouth agrees to work cooperatively with MCIm to provide Network Elements that will meet MCIm's needs in providing services to its subscribers. 3.4 Unless otherwise requested by MCIm, each Network Element and the connections between Network Elements provided by BellSouth to MCIm shall be made available to MCIm on a priority basis, at any Technically Feasible point, that is equal to or better than the priorities that BellSouth provides to itself, BellSouth’s own BellSouth subscribers, to a BellSouth Affiliate or to any other entity.
Standards for Network Elements. 11.1 If one or more of the requirements set forth in this Agreement are in conflict, CLEC shall elect which requirement shall apply. 11.2 Each Network Element and the interconnections between Network Elements provided by PACIFIC to CLEC shall be at least equal in the quality of design, performance, features, functions and other characteristics, including but not limited to levels and types of redundant equipment and facilities for power, diversity and security, that PACIFIC provides in PACIFIC network to itself, PACIFIC's own customers, to a PACIFIC affiliate or to any other entity. 11.3 In the event that CLEC reasonably believes that the requirements of this Attachment 6 are not being met, the Parties will meet and confer concerning such engineering, design, performance and other network data, which may be necessary to cure any engineering, design performance of implementation deficiency. In the event that such data indicates that the requirements of this Attachment 6 are not being met, PACIFIC shall cure any such deficiency as soon as possible.
Standards for Network Elements. 3.1 Each Network Element shall be furnished at a service level equal to or better than the requirements set forth in the technical references identified herein for each such Network Element, as well as any performance or other requirements, identified in this Attachment, subject to Sections 1.3.1 and 1.3.2 of Part A of this Agreement. 3.2 If one or more of the requirements set forth in this Agreement are in conflict, the Parties agree to resolve such conflict in accordance with the, dispute resolution provisions of Part A of this Agreement. 3.2.1 U S WEST shall provide to AT&T, upon request, engineering, design, performance and other network data sufficient for AT&T to determine that the requirements of this Section 3 are being met. In the event such data indicates that the requirements set forth herein are not being met, U S WEST shall, within ten (10) days, cure any design, performance or other deficiency and provide new data sufficient for AT&T to determine that such deficiencies have been cured. 3.2.2 U S WEST agrees to work cooperatively with AT&T to provide Network Elements that will meet AT&T's needs in providing Telecommunications Services to its subscribers. 3.3 Unless otherwise requested by AT&T, each Network Element or any Combination thereof and the connections between Network Elements provided by U S WEST to AT&T shall be made available to AT&T at any technically feasible point, that is equal to or better than the manner in which U S WEST provides such Network Elements, Combinations and connections to itself its own subscribers, to a U S WEST Affiliate or to any other Person. If the parties cannot reach agreement, the dispute resolution process set forth in Section 16 of the General Terms and Conditions of this Agreement, incorporated herein by this reference, shall apply. 2.12.3 The quality of the Network Elements as well as the quality of the access to said Network Elements that BellSouth provides to AT&T shall be, to the extent technically feasible, at least equal to that which BellSouth provides to itself. Detailed performance standards and measurements for Network Elements are set forth in Attachment 9 of this Agreement, incorporated herein by this reference. 2.12.4 Except as otherwise specified by law, BellSouth shall not impose any limitations, restrictions or requirements on requests for or use of Network Elements or Combinations that would impair the ability of AT&T to offer a telecommunications service in the manner AT&T intends, provided such use does not impede or impair the use of BellSouth’s network by BellSouth or any other telecommunications carrier utilizing said network.

If another Xxxx Communications Research, Inc. (“Bellcore”), or industry standard (e.g., American National Standards Institute (“ANSI”)) technical reference or a more recent version of such reference sets forth a different requirement, AT&T may request, where technically feasible, that a different standard apply by making a request for such change pursuant to the Bona Fide Request Process identified in Section 1.1 of the General Terms and Conditions of this Agreement. 30.10.2 If one or more of the requirements set forth in this Agreement are in conflict, the parties shall mutually agree on which requirement shall apply. If the parties cannot reach agreement, the Alternative Dispute Resolution Process identified in Section 16 of the General Terms and Conditions of this Agreement shall apply. 30.10.3 Each Network Element provided by BellSouth to AT&T shall be at least equal in the quality of design, performance, features, functions and other characteristics, including but not limited to levels and types of redundant equipment and facilities for power, diversity and security, that BellSouth provides in the BellSouth network to itself, BellSouth's own Customers, to a BellSouth affiliate or to any other entity for the same Network Element.

Each Network Element and the interconnections between Network Elements provided by ILEC to CLEC shall be at least equal in the quality of design, performance, features, functions and other characteristics, including but not limited to levels and types of redundant equipment and facilities for power, diversity and security, that ILEC provides in the ILEC network to itself, ILEC's own customers, to an ILEC Affiliate or to any other entity. ILEC shall provide to CLEC, upon reasonable request, such engineering, design, performance and other network data sufficient for CLEC to determine that the requirements of this Section 36 are being met. In the event that such data indicates that the requirements of this Section 36 are not being met, ILEC shall, within 10 days, cure any design, performance or other deficiency and provide new data sufficient for CLEC to determine that such deficiencies have been cured.
